However Sharma and Gupta both RSS members will not be able to walk free, as they are presently in the judicial custody in Ajmer Bomb Blasts case and they are also accused in Samjhauta Express bomb blast case.

The defense counsel for the accused’s K. Ramchander argued before the court that NIA has failed to furnish any material or circumstantial evidence against his clients, so they are eligible for bail. While NIA opposed the bail citing the apprehension that accused’s could influence the witness.

Lokender Sharma and Devender gupta in June this year was also granted bail in 2008 Malegaon bomb blasts case, because NIA failed to file charge sheet against them in 90 days prescribed time period. In the same month Bharat Rateshwar alias Bharat bahi was also granted bail in Mecca Masjid blasts as NIA failed to file charge sheet against him even after 180 days of custody.

Sharma and Gupta both were arrested by Rajasthan ATS in 2010, from ATS custody they were shifted to the custody of CBI and then to NIA, now the duo is planning to move for bail in Ajmer and Samjhauta express bomb blasts cases.
