New Delhi : In a breather to over 1,700 structures that are allegedly encroaching upon the area within five metres of Parkota heritage wall in Jaipur, the Supreme Court on Friday said those structure would not be pulled down till July 10.
The vacation bench of Justice A.K. Sikri and Justice Uday Umesh Lalit put on hold the razing of these structures as Attorney General Mukul Rohatgi told the court he has recommended to the Jaipur Municipal Corporation to amend its bye-laws to protect these structures.
The Rajasthan High Court had ordered the demolition of these structures from May 15 as they encroach into the five-metre radius area around the heritage wall.
The apex court gave a breather to the establishment owners on petitions by Jaipur Old city Citizens Welfare Society and Indira Bazar Vypar Mandal.
“It is in your hand to change the rules. Every rule is amendable,” the court told Rohatgi as he urged the court that it was a human issue and some arrangement has to be worked out.
“I have recommended the change in rule. It is 47 degrees Celsius in Jaipur – 1,729 properties have been ordered to be razed, 550 odd are government corporations,” Rohatgi told the court seeking its intervention.
Seeking some relief, he said: “We will do it (change the rules) and come back to the court.”
Noting the attorney general’s statement that there was a move on the part of Jaipur Municipal Corporation to change the bye-laws to give protection to those who own those structures, the court, while putting on hold the demolition drive till July 10, asked the JMC to go back with the amended bye-laws before the high court for further relief.
