New Delhi : A court here on Monday granted regular bail to Jawaharlal Nehru University Students’ Union (JNUSU) president Kanhaiya Kumar and two others accused in a sedition case after Delhi Police didn’t oppose their plea and said they had cooperated with the probe.
Additional Sessions Judge Reetesh Singh granted bail to Kanhaiya Kumar, Umar Khalid and Anirban Bhattacharya.
“In view of the fact that these three accused are on interim bail and have joined the investigation as and when called, I admit all these accused persons i.e. Kanhaiya Kumar, Anirban Bhattacharya and Umar Khalid to regular bail on the same terms and conditions on which they were granted interim bail,” the court said.
“The bail bonds and surety bonds have already been furnished by these accused persons at the time of availing interim bail. The same bonds shall remain in force till further orders.”
The order came after Delhi Police did not oppose the bail application of the students and said that they had cooperated in the probe.
Special Public Prosecutor Rajiv Mohan told the court that if the accused are granted bail, then certain conditions should be imposed as the investigation is currently on.
He also informed the court that the accused students did not violate any condition of the interim bail.
The Delhi High Court last week had asked Kanhaiya Kumar to approach the sessions court with his bail application.
The JNUSU chief then moved the sessions court seeking regular bail as his six-month interim bail is scheduled to expire on September 1.
In his bail application, he assured that he will adhere to every condition imposed by the court, and that he has not violated any of the conditions that were imposed by the Delhi High Court while granting him interim bail on March 2.
While granting the interim bail, the high court had warned him against participating “actively or passively in any activity which may be termed as anti-national”.
Kanhaiya Kumar was arrested on the charge of sedition for taking part in a controversial event on Kashmir held on the university campus on February 9.
In his fresh bail plea, he has stated that he had fully cooperated with the Delhi Police in investigation and joined the probe whenever required. He also maintained that he did not interfere in the ongoing probe.
He also mentioned that he provided password of his mobile phone to the Delhi Police when it asked for it.
Kanhaiya Kumar’s bail plea was filed by advocate Sushil Bajaj, who said the student leader deserves a regular bail because so far the Delhi Police has not filed any chargesheet in the case.
