Communal Violence (Prevention, Control and Rehabilitation of Victims) Bill, what sould be done with it?

It is clear that the Bill is presented just to grab votes in UP Election giving chocolates to Muslims, SC and SC. Also it tries to make happy the north Indians living in maharastra.. Good work to win UP Election. But one thing is to be noticed in this bill is that the law makers stand is the majority are always wrong. And the Bill if enacted will be used in case of big cases like Godhra and kandhamal, but not for small cases like killing of kar sewaks and killing of Swami Laxmanananda.. Although kapil Sibal tried to attract hindus by saying the Bill will secure the kashmiri Pandits.. But perhaps he forgot, kashmiri pandits are no more in Kashmir, they were kicked out from their homes by congress much earlier. And the places where they are staying now is Hindu majority. So they are not even protected in true sense. He quoted names of 5 more states where Hindus are minority to which the Bill will be applicable. But he forgot to mention true picture of the states. Even the Govt. of India has very less control over these states.

It seems that the bill is good for the nation. But who will guarantee that this law will not be misused? The bill should also include how to curb the misuses and severe punishment for misusing should be clearly prescribed, with a time bound schedule.

Introduce MIRANDA LAW in the COMMUNAL VIOLENCE BILL as they have in the Western Countries.
There is a law in USA called MIRANDA RIGHTS. Under this LAW
(1) The accused has the right to call a lawyer when he is under the police custody. He can demand that he wants to speak to a lawyer.
(2) He can ask for a lawyer to be present during any questioning.
(3) If the accused cannot afford a lawyer, one will be provided for him at government expense.
(4) Anything that the accused say in front of his lawyer can and may be used against him in a court of law, but in India, the police torture the accused and make him confess and sign statements which are produced to the judge as sworn statements.

It is good to introduce COMMUNAL VIOLENCE BILL provided it protects Indians AS OPPOSED to POLICE / POLITICIANS who are supposed to do PROPER DUTY and PROTECT innocent INDIANS from marauding INDIANS.

Marauding INDIANS roam freely, giving courage to other Indians to go-on-feast at time of opportunity. Politicians are on look-out for this opportunity to abuse their efforts, and gain political points. This fact cannot be ignored by anyone with a SANE mind.

If marauding culprits are brought to justice, and those who hired, and benefited from their acts are barred from contesting in elections - CV bill is workable. Otherwise, it will be like "shedding crocodile tears", just to please public, by passing a bill to "quench public thirst / demand".

Booking and bringing justice to culprits is a DOUBLE-EDGED SWORD. It will give confidence to Indian Masses and give faith in justice system, and send a STERN WARNING to would-be actors of violence, in future.

It is good to introduce this bill with changes in Present Parliament Session.
