Reservations for religious minorities in India :: How Fair are Ranganath Misra Commission Inferences
The debate on religion based reservations for “minorities” in India ( muslims / Christians/ jains / Parsi/ Sikh /others ) need be ended. Rather it has to be forcedly ended. But in the culture as it prevails in 2012 it can not be done so unless mass pressure is mounted on the politicians to stop playing unfair divisive cards. Otherwise the politicians will not stop pitching Indian against Indian simply for fleecing the VOTE. India has a parliamentary democracy and so the Indians have to live with the politicians. One would ask who can mount the pressure ?
In principle, Indian Elders while framing the Constitution might have been of the view that (i) over the centuries some people had been discriminated on the basis of professions they held (ii) such people had been unfairly pushed socially and educationally to the wall (iii) and hence they needed some extra support from the State in Democratic Republic of India. Ranganath Misra Commission Report ( 2007) has also in principle accepted this. The report says Group at Schedule Caste Art 15 (4) is religion and caste based and arises out of the practices of untouchability among Hindus, Sikhs and Buddhists.
So, then it had been the Hindu who was accused the most of discriminating against fellow Hindu on caste basis. British too had advocated and promoted such concepts. During British times a group was titled ‘Depressed Classes’ in the 1931 Census and it was only out of the “ Hindu”. The “ depressed classes “ were notified for the first time as “Scheduled Castes” in the Government of India Act, 1935.It was less for the welfare cause and more out of the British intentions to divide the Indians in more groups. Had it not been so, then surely the depressed classes would have been identified also out of Muslims, Christians, Sikhs, Jains , Buddhists, etc as well by the British Government. Government of India (Scheduled Castes) Order was issued in April 1936. Ranganath Misra Commission (National Commission for Religious and Linguistic Minorities ) report too acknowledges that the criteria adopted for purposes of specifying the Scheduled Castes was ( more ) based on the obnoxious practice of untouchability.
The test applied was the social, educational and economic backwardness arising out of the historical custom of untouchability. Social and Political leaders of Hindu did accept the allegations of untouchability. Where as the Social and Political leadership ( particularly) of Muslims & Christians did not that much plead / submit that there was also some caste / sect / occupation based social discrimination with in their communities. They claimed that they held a fully internally supported society.
It was assessed that the socially discriminated castes/groups were suffering of the worst social and educational backwardness resulting in marked and continued economic and administrative backwardness. So, in the Indian Constitution and while drafting THE CONSTITUTION (SCHEDULED CASTES) ORDER, 1950 only socially & educationally discriminated castes from amongst Hindu were included. The test applied was the social, educational and economic backwardness arising out of the historical custom of untouchability. THE CONSTITUTION (SCHEDULED CASTES) ORDER, 1950 adopted in full the list drawn in 1936 for Schedule Caste.
Later the Buddhist and Sikh leadership suggested caste discriminations amongst them also and hence castes from Sikh and Buddhists were also in included in SC in 1956 and there after. Unfortunately other religious leaders did not accept the reality of caste discriminations. Had they accepted such discriminations prevailing amongst them also, I am sure the scope of schedule castes ( list) would have been expanded and the politicians would have been checked from cultivating caste / religion based differences amongst Indians. I may be corrected in case my reading is wrong.
Bihar Chief Minister Nitish Kumar suggested for a Muslim quota and inclusion of Dalit Muslims in SC category at a Conference held by All India Pasmanda Muslim Mahaz on 1st July 2010 in Patna. In the words of Nitish Kumar <“In India caste has deep root, people change their religions but not castes. So, persons belonging to SC category whether they are Muslims or other should be treated in the same manner. Discrimination on the basis of religion is not good for democracy. At the time when I was MP, I had raised the issue to remove the condition of religion from Article 341, but unfortunately it has not been done till date,” What Nitish Kumar said regarding Muslim quota could be debated. But one thing that need be well received from Nitish Kumar is that those who change religion ( since they had been facing caste based discrimination / social backwardness in the religious society they abandoned), may still keep on facing discrimination even after change over in the new religion / society. That means that it was wrong to attribute the alleged curse of caste based / profession based social discrimination to only “Hindu” Had leaders of Hindu /Muslims / Christians truthfully accepted in 1949 -50 (i) that the castes and social discrimination are not limited only to those who profess Hinduism but could be there in any society: and (ii) had the Muslims/ Christian social leaders also named any socially discriminated castes amongst them ; (iii) then the socially and educationally backward castes from amongst the muslims / Christians / Parsi / Bhudist too would have been included in “ depressed classes” (SC) category in 1950/ 1956 it self. So, the reservation for the SC would have been kept more than 12.5% as kept in 1950 and 15 % as raised in 1970 ( may 18% or even more). This way the politicians. thereafter would have been surely checked to a reasonable extent from exploiting the Hindu / Muslim/ Christians / Sikhs in the name of religion. Politicians are trying to send wrong signal to the religious minorities in India that it is the Hindu majority that is responsible even for the backwardness of some amongst the other religious communities. Where as even Ranganath Misra Commission report 2007 no where says so. Even a few centuries before Independence the Hindu did not have dominant role in the administration of law. Politicians have been continuously pitching Hindu more against Muslim in the name of minorities ( they actually are targeting only muslims since Indian muslims have nearly as large a population as that of Pakistan).
Why even the social leaders of Hindu / Muslim/ Christian are playing in the hands of politicians is not understood. Our Constitution lays down caste sect/ group based reservations. So from where comes the question of Minorities as a separate identity? This has to be resisted by both the common Hindu and Muslim.
So, if even in 1950 there were also some amongst other religious communities / sects ( Muslim, Christian, Parsi, Budh, Jain) who were socially discriminated – socially& educationally - ( Ranganath Misra report admits and quotes repeatedly but still overlooks the pointed and ultimate solution, why ?) , they too could be declared as discriminated castes amongst them by their social leadership ( by name of their caste or sect or so amongst their religion ) . Even after 1950 by suitable amendments in Constitution these castes could also be included in the SC and the present 15% reservation could be raised to higher level. So, if atall there are caste based socially discriminated people amongst the muslims , even now , these castes could also be included in SC. This would check the politicians from pushing the HINDU , Muslim, Christian , Parsi, Sikh of India into more and more conflicts every next day .
Keeping reservation with in reservation for a religious minority separately and then listing the castes of that religion as claimants for that part is surely wrong. WE must, atleast now after 64 years of Indian Independence, check our own PEOPLE from dividing us further.
Ranganath Misra Commission (2007) report too needs to be deliberated further. As regards including the discriminated socially and educationally backward castes amongst the Muslims / Christians/ Jains/ Parsi in the SC under Article 341 and THE CONSTITUTION (SCHEDULED CASTES) ORDER, 1950 there should be no problem. Let the Muslim leaders accept social caste discriminations in their society and frankly name socially and educationally backward castes amongst the muslims for inclusion in the SC list the way discriminated castes amongst Hindu / Sikh / Buddhist have been included. The socially and educationally backward amongst them have already suffered for 6 decades due to their non inclusion.No doubt the politicians would be less interested for such like one time remedial correction/ actions .
But surely Ranganath Misra Commission report suggesting further (additionally) 10% reservation quota for Muslims and 5% for other religious minorities or split share for some as religious minorities out of 27% reservation for OBC or like marking 15 % of development / other programmes for religious minorities is not at all in the interest of India as well as the people of India who practice different religious faiths. No separate reservations as Muslims or Christians or as Jain or as Sikh or as Buddhists since there are no reservations pointedly as HINDU in the Constitution. There are no separate reservations caste / sect wise in SC for socially and educationally backward Hindu or Sikh or Budh, all listed in SC list compete with each other. Let all socially and educationally backward from Muslim, Christian , Hindu , Sikh, Budh & Jain where ever / when ever listed in Schedule Castes compete with each other as a unit as they do as Schedule Tribe (ST). But Ranganath Misra Commission report too has not dared to truthfully advise , rather appears struggling to accommodate some suggested inferences and not laying truthful and scientific end solutions without ifs and buts.
In 1950 socially and educationally backward castes / people were seen only amongst Hindu and reservation of 12.5% ( raised to 15 % in 1970) was kept for SC. It was targeted to end such discrimination by 1960. But instead the backwardness amongst some more people has erupted / has been identified ( instead of reducing ) over last six decades. We have today more backward people as OBCs (27 % reservations ).It speaks of the utter failure of those holding the reins of management of socio economic development after 1947.
In case OBC listed after 1990 had been denied cover of reservations for 40 years then they should have been given still better treatment , why creamy layer only for them, one could question? Why should not the creamy layer be extended to all reserved categories ( even if a Constitutional provision is to be made ), a member OBC could ask? This clearly speaks of the mal intentions of the politicians who have otherwise been boasting of being the well wishers of the depressed classes.
The Muslims Christian, Parsi , Sikh , Buddhists are now being exploited in the name of minorities after the Hindu having been exploited in the name of Castes. I hope I shall not be misunderstood by my fellow countrymen. Indians must come together to check the political leadership from playing divisive games in the name of RELIGION. No doubt in the Ranganath Misra Commission report many positive notes too have been summarized ( of course not as recommendations , why ?) but the politicians appear to have not taken a fair leads from those, may be it does not suit them. The report must be make public for debates. The report has many references that would expose the ill intentions of those who have ruled India. Rather the HINDU and Muslims of India must come together and expose the politcians.

Justice Ranganath Misra Commission Report has many useful fact that have not been made public, why ?. The report must be made public for discussions. There are some politicians in India who do not want that differences in name of religion / caste should settle. Rather they want the confusions and doubts to stay. Ranganath Misra Commission had been asked to look for how reservations could be extended to religious and linguistic minorities and commission had to only observe in this direction. During the course of data collection many other unrevealed facts on the non yielding welfare programmes and intentions of the political leadership had come before the Commission. Although the Commission has mentioned many other things in the report but the commission had to restrict only to terms of reference. Therefore, once the contents are fully made public the communal differences where created by political leaders would end . Other important thing that would emerge is that people will come to know that the politicians have only intentions for exploitation of sentiments of people on religion base to secure votes and there is no intention for the welfare. The report that was presented in 2007 had only been used to send a message to the larger religious groups other than Hindu ,that it is the Hindu who is behind the backwardness of any other member of non Hindu religious minorities. Where as Misra commission has no where said that the social, educational and economic backwardness ( where ever there) of the religious minorities in India is due to ill intentions of the Hindu religious majority. Instead the Report at many places has talked of social discrimination existing internally amongst groups irrespective of the religion they hold. The status of SC inspite of 60 years of reservations has been reflected in the report in very painful manner , some where even bad in comparison to religious minorities. Unfortunately some social and religious leaders too have played in the hands of politicians. Hindu & Muslim need to be made aware of the ground realities as regards the intentions of the VOTE merchants who do not want to even use the useful signals that otherwise emerge from the Misra report. Tamil Nadu Thowheed Jamath (TNTJ) has planned to organise a massive conference in Chennai on 4th July 2010, Demanding Separate Reservation in Education and Employment of Central Government said S. Sithiqu M. Tech – Secretary – TNJ Students Wing accompanied by M. Sarvath Khan, Assistant Secretary and Executive Member K.M.S. Sadiq Batcha.
Muslims had Reservation in Pre-Independance period, the right was snatched away by the so called secular Government. Even after 60 years of Independence, the status of Muslims is far below than the national Average and other Socio-Religious communities.
To review the status of backward communities, the Central Government has appointed the famous named committee “Mandal Commission”, which has outlined in detail including Muslims community. Subsequent to Mandal Commission, Central Government, has appointed Justice Sachar and Justice Ranganath Misra Commission to study the status of Indian Muslims in Education, Employment and socio-Economic conditions.
Justice Sachar and Justice Ranganath Misra Commissions had rightly outlined the pathetic conditions of Indian Muslims and to overcome the issue, the committee has suggested a number of Measures. One such important measure was to provide a Separate Reservations for Muslims in Education and Employment of Central Government, reference to Provisions of Constitution of India, vide Article 15,16(4) and 46.
Muslim backwardness is a National Problem
The Report has made numerous recommendations for urgent governmental action to redress the problem of Muslim backwardness. This is essential not only in the interest of equity and fair play. It is also in the National Interest because no country can hope to progress if it leaves behind 150 million of its population.
To speed up our Demand and pressure the Central Government to act on the Recommendations, TNTJ has organized Nationwide Campaign to create awareness among Muslims and take the support of Secular People. As a first step, Tamil Nadu Thowheed Jamath (TNTJ) has planned to organise State Level Massive Conference in Chennai on 04th July 2010, in which 15 Lakhs Muslims across the state is expected to take part in this conference and TNTJ will invite all Muslim Political parties across India, to take part in this conference.
TNTJ is in co-ordination with like minded Group, to form a Nationwide Movement to organise Nationwide Muslims Conference, across India and to take the issue Nationwide more aggressively.
Further, Mr. S. Sithiqu M.Tech said that, Muslims demand for Reservation is not based on Religion, based on their Educational, Employment and Socio-Economic Status and the Constitution has provisions to accommodate such demand. Muslims main Agenda and demand in the coming days will be Separate Reservations. It’s high time, the Congress should realise the importance. In the Past Muslims were depending mainly on the Congress alone! But today’s prevailing political scenario, Muslims look forward to align with Even Non-Congress Secular parties!! The congress can’t treat the Muslims just for Vote bank politics alone!!
Commission Reprt on Muslims are meant to be showcase pieces
Rangnath Misra Commission Report will never be implemented simply because it is more important for the Congress Party to appease the 80% Hindus, rather than the 14% Muslims.This is simple political arithmetic.
Non-Muslims get reservations, concessions, privileges because when they vote they demand those things.
But Muslims vote out of fear of communal riots, butchery, demolitions, Gujarat like massacre etc and so after the elections they get back the fear.
When the Muslims ask for reservations not based on religion but based on their economic deprivation, they get commissions, just to please them and the commission reports are absolute eye wash and a huge deception.
Never in the history of 62 years of India, any commission that does any favourable report on Muslim minorities has ever been implemented.
So what is the solution? Political polarisation. Big Muslim Bosses in all the main political parties should tender their resignation, say good-bye and leave their parties and lose their incomes and start a huge political party that can unite the entire Muslim Umma of India, and then THAT will create fear in the minds of the politicians and then we can get at least some of our reasonable demand met.
Otherwise there is no chance
One OTHER solution. Forget about Govt crumbs and start working hard, educate our children, start our own businesses and try to emulate the Jews of the USA and empower ourselves economically, then the politicians will be our mercenaries, after all the entire national system works on bribery in India from peons to Ministers.
But this solution requires tremendous sacrifice and tremendous AMAL JARIAH from the rich Muslims who are mostly tight fisted.

The Constitution (Scheduled Castes) Order 1950 paragraph 3 defines a Scheduled Caste in terms of religion and not in terms of social educational backwardness. Hence it is an order that goes against the secular principles enshrined in the Constitution. The criterion should be social and educational backwardness. Since the last Major judicial pronouncement on Dalit Christian issue (Soosai Vs Union of India) there is a lot more evidence available on the social economical and educational backwardness of Dalit Christians and as per this study "there is no compelling evidence to justify denying SC status to Dalit Muslims and Dalit Christians." Every fair- minded Indian would support the cause of Dalit Muslims and Christians on basis of justice

If India is really secular state, special previleges should not be given to any group based on religion. It is sheer hypocricy for some religious groups to claim religious credentials when they want special previleges and claim freedom from the obligation to obey and behave like the rest of the citizens when they are required to obey the laws of the country.
Afterall, nobody in his senses can claim Muslims remained backward in India due to suppression by Hindus, because the former were ruling the country for about a thousand years until the advent of the British.At the time of the British departure, Muslims extracted their pound of flesh.
if it is true that they they are economically backward now, it is because they prefer to adhere to outdated customs and to a type of education that indoctinates them against the mainstream life of people and to live in their exclusive sectarian religious shells.
There are millions of people poorer than some Muslims.It is they, who are really suppressed by a series of national governments to please the so called religious minorities. Afterall,why should religion be taken as criterion for classifying as minorities, unless it is aimed at creating class conflict and gaining political advantage? The criterion should be economic and physical disabilities if the government is honest. The report should be shelved.
