Dhaka : The high court here has struck down a provision in a newly enacted ordinance, clipping the absolute powers of the country’s president in the appointment of higher court judges, justice ministry officials said Friday.
A three-member bench scrapped section 9(4) of the newly declared ordinance that vests absolute powers in the head of state in the matter of appointing judges of the higher judiciary.
One of the division judges also called the ordinance illegal and unconstitutional.
Court petitioner Idrisur Rahman said that the issue had to be finally resolved by the Supreme Court as it involved interpretations of the constitution.
The scrapped section of the ordinance had empowered the president to throw out the Judicial Commission’s recommendation on the appointment of judges by mentioning reasons in writing.
