New Delhi : The Association of Victims of Uphaar Tragedy (AVUT) Wednesday filed a revision petition in the Delhi High Court asking that real estate tycoons Sushil and Gopal Ansal and three others be sentenced under culpable homicide not amounting to murder instead of negligence.
The matter is likely to come up for hearing on Thursday.
“We have approached the court demanding that section 304 A imposed on the Ansals and the other three be changed to section 304 of Indian Penal Code (IPC),” said Neelam Krishnamurthy, convenor of the AVUT.
The lower court had Nov 23 charged theatre owners Ansals under Section 304 A (causing death by negligence), 337 (causing hurt by act endangering life) and 338 (causing grievous hurt by act endangering life).
Municipal Corporation of Delhi (MCD) officials N.D. Tiwari and Shyam Sunder Sharma as well as the fire department’s H.S. Panwar were similarly charged.
The high court has also issued notice to the Central Bureau of Investigation (CBI) asking it to file by Jan 30 its reply on petitions by former Delhi Vidyut Board employees Vir Singh and B.M. Satija who have challenged the seven-year sentences.
The high court will start day-to-day hearing in the case from Feb 15.
Fifty-nine people were killed on June 13, 1997 when a fire broke out at the south Delhi theatre that was screening “Border”.
