New Delhi : The prosecutor in the 1999 BMW hit-and-run case Monday said the victim’s first statement, immediately after the accident, should be relied upon as he has retracted his statement under the influence of the family of the accused.
Public Prosecutor Rajeev Mohan cited the statement of witness Manoj Malik, who in his statement to assistant sub-inspector Devendra soon after the accident had said that he was hit by a car.
Later, Malik retracted from his statement and said it was a truck that had hit him.
Counsel Friday said a BMW relief fund, set up by Suresh Nanda – a prominent arms dealer and father of the accused Sanjeev Nanda – was the reason for Malik to go back on his earlier statement.
Sanjeev Nanda is alleged to have mowed down six people, including three policemen, with his BMW car Jan 10, 1999 in Lodhi colony area in south Delhi.
Besides Nanda, four others were booked for culpable homicide not amounting to murder and destruction of evidence.
The arguments in the case would continue Tuesday.
