New Delhi : Jamiat-Ulama-I-Hind president Maulana Arshad Madani Monday moved the Supreme Court for a judicial probe into the Malegaon riots of 2001 and the subsequent blasts there in 2006 and 2008.
Madani sought probe by a retired judge of the apex court or a sitting judge of the high court into the incidents.
The petition sought directions to the Central Bureau of Investigation (CBI) to expedite the probe into the Malegaon riot of 2001 and pleaded for its monitoring by the court. It also sought making public a probe by the retired judge of the Bombay High Court Justice K.N. Patil into the 2001 Malegaon riots.
The petitioner said that the CBI be directed to consider the report he earlier submitted. The petition said that Malegaon unit of the Jamiat-Ulama-I-Hind gave a detailed report of the involvement of Hindu fundamentalists in the blasts but it was ignored. The petition has also pleaded that the CBI report into the 2001 riots be submitted to the apex court.
The petition has also pleaded for the release of nine Muslims who were arrested in the wake of 2006 blasts. The petition said that all the nine, arrested under the Maharashtra Control of Organised Crime Act, were innocent and because of their arrest under the preventive law they were not being granted bail.
The petitioner said that the state investigating agencies did noting even after clear evidence of the involvement of Hindu fundamentalists. The petitioner said that a “fair and unbiased” investigation would bring the truth behind all the blasts that have taken place in other parts of the country.
The petition has catalogued various blasts and incidents related to them since 2001.
It said on an earlier occasion too retired army personnel Madan Mohan Shinde and his brother Laxman Shinde lost their lives in an explosion that was caused while assembling a bomb at their residence in Mahad taluka. The petitioner’s senior counsel Anis Suhrawardy is likely to make a mention of the petition before the court of Chief Justice on Tuesday.
