Delhi constable’s widow gets Rs.1.5 mn accident claim

New Delhi : An accident claim tribunal Tuesday awarded Rs.1.5 million compensation to the family of a Delhi Police constable who was killed in an accident in 2006.

The tribunal presided by J.P.S Malik awarded the money along with interest at the rate of nine percent to be given to family members of deceased constable Namdev Pawar.

Holding driver Gagan Thukral and Atma Prakash Thukral, owner of the Maruti car which was involved in the accident, responsible for the death of 32-year-old Pawar, the tribunal asked National Insurance Company Ltd to pay the compensation to the victim’s family.

The tribunal was deciding the claim petition filed by Neelam Pawar, the widow of the constable, her mother-in-law and two sons – Jayesh and Mahesh, all hailing from Nasik district of Maharashtra.

The victim was dragged around 30 meters after a rashly driven Maruti Esteem car hit his motorcycle from behind in Panchsheel Park area in south Delhi April 11, 2006 at 1.30 a.m.

While computing the compensation amount, the tribunal relied upon the service records of the victim, produced by the Delhi Police.

It also rejected the insurance company’s plea that it cannot be asked to pay the compensation, as the accused driver, according to the police, was drunk.
