Mumbai: The special TADA court hearing the1993 Mumbai serial blast cases ordered police on Monday to release the two Kashmiri Muslims arrested in Nepal by CBI as accused in the serial blasts.
Special TADA Judge D U Mulla said Reyaz Ahmad Lone and Ashfaque Ahmad Taq whom the CBI said were absconders in the 93 blast case are innocent and the CBI must take them to their homes in Kathmandu from where they were picked.
Their counsel Farhana Shah said that Reyaz has been living in Nepal for 20 years. He has a 13-year-old son. After having Iftar he was going to the mosque when he was picked. The counsel told the court that Ashfaque Ahmad Taq is from Jammu. He worked in Saudi Arab till 1995, then shifted to Nepal and married there and settled.
The CBI had arrested Reyaz as Reyaz Khatri and Ashfaque as Salim Abdul Ghani. The two are accused in the Mumbai blast against whom red corner notices were issued.
The arrested Kashmiris informed the court that neither they nor their families were informed why and where they were being taken to. They said they are simple Kashmiri and they had no role in the blasts.
According to PTI report, the CBI has also admitted that its a case of mistaken identity.
After verifications, the CBI has found that the two persons are not those accused against whom red corner notices have been issued and that they have no connection with the blasts or the underworld, special public prosecutor Ujwal Nikam has been quoted saying.
