Court refuses to free two ‘framed’ Kashmiris

New Delhi : In a major setback to the Central Bureau of Investigation (CBI), a court here Friday refused to free two Kashmiri youth, who the agency said were falsely framed by the Delhi Police’s Special Cell as terrorists of Al-Badr.

Additional sessions judge S.K. Gautam rejected the closure report of CBI, stating that the facts submitted by them were not conclusive and need a thorough trial.

He fixed Feb 28 for argument on charges.

The court also rejected the plea of Irshad Ali and Mohd Qamar for their discharge in the case as the investigation agency did not find any evidence against the two, who have been lodged in Tihar jail since 2006.

Suffian Siddiqui, counsel for Ali, said they would challenge the order in the high court.

The Special Cell arrested Ali and Qamar Feb 9, 2006 from the G.T. Karnal Road bus terminal and said they were Al-Badr terrorists. The police claimed that pistols, RDX, detonators and other explosives were recovered from them.

The CBI, in its closure report submitted last year, held that the two alleged terrorists were innocent and wrongly framed. The investigating agency even came to the conclusion that the two were working as police informers.
