New Delhi : The Delhi High Court Friday issued notice to Delhi Police Special Cell asking why two young men from Jammu and Kashmir arrested as terrorists but declared innocent by the Central Bureau of Investigation (CBI) cannot be released.
Irshad Ali and Mohammed Qamar approached the high court after a trial court last month declined the closure report filed by the CBI giving them a clean chit in the case filed by the Special Cell in 2006.
The trial court had rejected the CBI’s closure report and said the facts submitted by the investigating agency were not conclusive and needed a thorough trial. Ali and Qamar are in Delhi’s Tihar Central.
Delhi High Court Justice M.C. Garg, after accepting the plea to quash the charges against the two, issued notice to the Special Cell and asked them to file a reply by April 20.
The Special Cell arrested the two Feb 9, 2006 from the G.T. Karnal Road bus terminal here and branded them terrorists from the group Al Badr. The police claimed to have recovered pistols, RDX explosives, detonators and other ammunition from them.
The CBI submitted last year that the two were innocent men and had been framed. The CBI even concluded that the two were in reality “police informers”.
