Bengaluru: The Supreme Court today sent notice to the Karnataka government asking it to submit a report regarding the bail plea of Abdunnasir Maudany, accused in the 2008 Bengaluru blast case. The plea will be considered again on April 29.
Famous lawyer Shanthi Bhushan argued for Maudany before the bench comprising of Js Markandey Katju and Gyan Sudha Mishra. Mr Bhushan reportedly said in his argument that his client was handicapped and was acquitted in the Coimbatore blast case after languishing nine and half years in jail.
Maudany submitted the bail plea in the SC via advocates Sanjay Jain and Adolph Mathew last week. The plea reportedly says that Maudany was not present there when the blast took place on June 25, 2008 in Bengaluru, and the prosecution admits it. This shows he is not directly linked to the case. Maudany is charged with only conspiracy and the prosecution could not prove even that. The plea reportedly adds that the case was politically motivated.
Maudany, chairman of Kerala’s People’s Democratic Party, approached the SC against the denial of bail by the Karnataka High Court on February 11 and earlier by the Bengaluru fast-track special court V.
Abdunnasir Maudany, who is the 31st accused in the case, has been in the Parappana Agrahara Central Jail for the last eight months. He was arrested by the Karnataka police from Kerala on August 17, 2010, when he was on his way to surrender in court. He was sent to the Parappana Agrahara jail on judicial custody after the completion of ten days’ police custody. He was earlier accused in the Coimbatore blast case and was in prison for long nine and half years as an under-trial, before being acquitted in 2007 finding him innocent of the charges.
