Delhi government’s power on consumer panel post restricted

New Delhi: The Delhi High Court has restrained the Delhi government from taking a final decision on the appointment of two members in the state consumer commission.

The court was hearing a plea questioning the government’s power to reserve two posts of the three-member commission – one for woman non-judicial member and the other for member (judicial).

In an interim order, Justice S. Muralidhar allowed the plea of Yashbeer Singh to apply for the post of member and said: “The petitioner (Singh) is permitted to apply for both the posts. His application will be considered but a final decision on the candidates to be appointed will not be taken by the respondent (Delhi government)”.

The court was hearing a petition filed by Singh challenging the government’s advertisement for the appointment of two members for the commission.

He said the state consumer panel consisted of three members, including the chairman. As per law, the government can reserve only one of the posts for panel’s members.

He claimed that in the recent advertisement, the government reserved both the posts of members. One for woman non-judicial member and the other for member (judicial), which is illegal.

The court has fixed Feb 15 for further hearing on the matter.
