Government for legislation for tort compensation

New Delhi : The law ministry wants that a legislation may be considered and special tribunals set up to deal with fatalities arising due to fire and similar such incidents.

Minister of State for Home M. Ramachandran stated this in the Rajya Sabha Wednesday in response to a query whether the government proposed to set up special tribunals in all 640 districts in the country.

The minister said the Supreme Court had in 1997 suggested bringing in a legislation to deal with tort claims for violation of fundamental rights by the state.

The claims for compensation in tort were now pursued in civil courts, which was a time consuming process, he said.

The law ministry then suggested setting up Fatal Incidents Claims Tribunals in respect of fatalities arising due to fire as well as storage of dangerous and hazardous substances.

“The proposal needs to be examined in consultation with other ministries,” he said. “The government will take a decision in the matter after thorough examination.”
