Swamy wants ‘juvenile’ rape accused tried with others

New Delhi : Janata Party president Subramanian Swamy Wednesday moved the Delhi High Court seeking prosecution of a gang-rape accused, who claims to be juvenile, in the fast track court along with the five others. He was told to approach a sessions court.

At present the case of the sixth accused in the Dec 16. 2012, gang-rape case here is being heard by the Juvenile Justice Board in keeping with the law.

Swamy said the accused claiming himself to be a juvenile must be tried with the other five adults as “the age of 18 years as the flat cut off waiver in criminal offences is inconsistent with the international conventions and, hence, is arbitrary”.

The division bench of Chief Justice D. Murugesan and Justice V.K. Jain disposed of the plea of Swamy and said that “there was no cause of action to entertain this petition at this stage”.

The court granted liberty to Swamy to move a sessions court if the Juvenile Justice Board did not allow his plea on the issue.
