Nimesh Commission report tabled on first day of UP Assembly

    Lucknow: Facing flak from all quarters over the failure of the administration to quell the Muzaffarnagar riots, Akhilesh Yadav government presented the RD Nimesh Commission Report on Monday in the Uttar Pradesh Assembly.

    The Nimesh commission report is related to the arresting of terror suspect Khalid Mujahid and Tariq Qasmi in 2007. Justice R D Nimesh had submitted its report to the state government on 31 August 2012. Both Khalid and Tariq were accused in serial blasts which occurred in 2007.

    Khalid Mujahid and Tariq Qasmi were arrested by the Special Task Force (STF) on 20 December 2007 from Barabanki. Huge explosives were also shown as recovered from his possession. STF claimed that he was involved in the serial blasts which occurred in Gorakhpur, Faizabad and Lucknow. Later, Nimesh Commission was constituted headed by Justice R D Nimesh who in its report raised fingers over STF’s claim about the place of arrest.



    Pressure was mounting on the state government with social organisations led by Rihai Manch (Forum for the Release of Innocent Muslims imprisoned in the name of Terrorism) continuing indefinite dharna demanding arrest of police officers involved in Khalid Mujahid’s murder, issuing the RD Nimesh commission report, and the immediate release of innocent Muslim youth imprisoned in the name of terrorism.

    Khalid had died under mysterious circumstances on his way back from Faizabad near Ram Sanehi Ghat last Saturday. He was declared brought dead by the doctors at district hospital in Barabanki. Later, on the complain of his uncle Zahir Alam Falahi, a case was registered against 42 police officers including former DGP Vikram Singh, ADG Brijlal and others who were on duty during the time of Khalid’s arrest.

    The state cabinet meeting chaired by CM Akhilesh Yadav accepted the Nimesh Commission report on June 4.

    Although the report was not officially released, the leaked report was available online. Chairman of the Rihai Manch Mohamamd Shoaib had said that it had already released the Nimesh Commission report on 18 March, earlier this year and so mere report is not sufficient and they expect from the government to also tell the public what actions they have taken on the report.

    After tabling of the report in the Assembly, Advocate Shoaib reiterated the demand for action taken report and accused the government of fooling the people by simply tabling the report, without any real action. He added that the government is shielding the erring Intelligence and police personnel by not acting.

    Rihai Manch is leading a sustained demonstration against the UP government for almost four months now demanding actions on its poll promise of releasing innocent youths languishing in jails in fabricated terror charges. Several rights groups and and politicians, including Prakash Karat, Subhasini Ali and Welfare Party leaders have also expressed their solidarity with the Manch demonstration and on different days made token participation. On the 117th day of Rihai Manch dharna outside Uttar Pradesh Assembly, flambeau were lit by protesters demanding release of innocent Muslim youths languishing in jail for years on ‘fabricated terror charges.’

    The Nimesh Commission Report has recommended that officials and staffs be identified involved in the ‘wrongful arrests’ and actions taken against them.
