Mother of terror accused alleges foul play by police in disappearance of her son from Howrah train

Mumbai: Mrs. Qamar Nasreen, mother of Shaikh Abdul Naeem – an accused in Aurangabad Arms haul case of 2006 and resident of Aurangabad, has rejected police claim that on Sunday Naeem escaped from the custody of West Bengal police when he was being escorted from Kolkata in Howrah-Mumbai Super-fast train for hearing of the case before Mumbai special court. She has alleged that the police might have illegally detained him at an undisclosed location and she is afraid that he might be killed in a staged encounter.

Nasreen has now written a letter to the Chief Justices of High Courts of Bombay, Andhra Pradesh and West Bengal and has prayed for high level inquiry in the sudden disappearance of her son from the custody of police.



Speaking with the regional newspaper she said, “My son is holding on to his patience since last 8 years for justice and there is no reason for him to escape as there is no evidence against him with the police to prove any of the allegations and also when the trial is nearing the end in couple of months”.

“Police have illegally detained him and I fear (that he) will be killed in the fake encounter. I have already written to high courts”, she said nervously.

She told the Times of India, “My son was suffering from kidney ailment and he was being escorted to Mumbai by five police personnel, including armed ones. It is not possible for a person ailing with kidney problem to give slip to five physically fit cops. Given the circumstances, there is a strong possibility that he may have been killed in encounter or detained illegally.”

Naim’s brother Dr. Abdul Hakeem said to the regional newspaper, “My brother is behind the bars since 8 years and there is no provocation for him to abscond from justice when he has already been acquitted from two cases and secured bail in one case”.

“How can it is possible for an accused to escape from the escort team of 5 policemen who have arms with them?” he questioned.

His brother also said that the family was sure of his acquittal in all the cases registered against him and claimed that there were no proofs against him in any of the case.

Reportedly Naim was arrested in 2007 from West Bengal and made accused in Makkah Masjid Blast (2007) in Hyderabad, Aurangabad Arms Haul case (2006) in Mumbai, fake passport case WB and two more cases. His family claims that he has been discharged from Makkah Masjid blast case and got bail in other cases except in Mumbai and WB.

Aurangabad Arms Haul trial in Mumbai which has been expedited by the order of Bombay High court is being conducted on a daily basis before special MCOCA court inside Arthur road prison. The trial is running against 24 arrested accused including Zabiuddin Ansari alias Abu Jindal, an accused in 26/11 case.

Police claims Naim escaped from a running train

On Tuesday Anti Terrorist Squad informed Aurangabad Arms Haul trial judge G T Qadri that Naim was in the custody of West Bengal police, a team of which was escorting him back to Mumbai from Dumdum jail in Kolkata after completion of hearing of a case in Bongaon and in between the route Naim escaped.

Reportedly WB police team of 5 men was accompanying him from Kolkata in the Howrah- Mumbai super-fast train. Naim allegedly jumped from the train when it got slow between Kharsiya and Shakti railway stations in Chhattisgarh on Sunday around 5.45am.

Special Court had on Tuesday asked ATS to submit a copy of FIR that might have been registered with the railway police so that the court may pass appropriate order in the case.

Adv. Nadeem Ansari, a lawyer from the Jamiat Ulema legal panel said to TCN, ”Prosecution have not submitted copy of FIR in the court today (Wednesday) and hence the court has not passed any order on the matter”.

He also said that Jamiat legal panel has not been approached by Naim’s family so far and hence Jamiat cannot talk about the allegations raised by his mother.

Although after the alleged escape of Naeem, the anti-terrorism squads of Maharashtra and Andhra Pradesh have alerted state police and looking for clues where he can hide after jumping from train.
