New Delhi: In response to the petition filed by one of the acquitted persons in Akshardham terror case of 2002, Supreme Court has suggested to first place the case before Gujarat High Court for legal action on erring Gujarat officers and to compensate his 11 years of agony behind bars.
The double bench of Supreme Court was hearing a writ petition on Monday, February 9, filed by Abdul Qayyum alias Muftisaab (45 years) when it suggested petitioner to approach Gujarat High Court under article 226 of the constitution and to only approach it if not contended by Gujarat high court order.
Qayyum had moved Supreme Court after eight months of his acquittal praying to criminally charge Gujarat police officials, who had fabricated the case against him, and also to compensate him for the 11 years he spent behind bars under false allegations.
Jamiat Ulama –e-Hind, a nongovernmental organization that had legally helped Qayyum and other accused in representing their appeal before the Supreme Court, is again extending help to Qayyum in representing the present petition too.
Jamiat appointed Supreme Court lawyer Irshad Ahmed and Senior Supreme Court lawyer K T S Tulsi for the petition.
Tulsi on Monday briefed Justice Gopalgauda and Justice Bhanmati about the grievances and grounds of the petition. After carefully listening to him the double bench opined for placing the case before Gujarat High Court and there by disposed of the petition.
After the proceeding of the case before Supreme Court Jamiat Ulama has expressed full resolve in helping all the acquitted men in meting out justice to them.
Maulana Arshad Madni, President of Jamiat Ulama –e-Hind said, “ We accept the suggestion of Supreme Court and will now file the petition before Gujarat high court.”
