Customs official gets court rap for ‘frivolous litigation’

Gandhinagar: A customs official who had approached Gujarat High Court on a matter of service rules but withdrew his petition at the time of admission of the case, Thursday came in for criticism from the court for “frivolous misuse of scarce judicial resources”.

“Filing a petition and withdrawing it at the time of admission is nothing but misuse of limited public resources and wastage of the time of the court,” it observed.

The court told the counsel of the petitioner that this was an attempt at raising frivolous issues which the petitioner himself did not find worth raising.

A superintendent of Customs and Central Excise, Ashok Bhatt, had approached the high court in a service matter and challenged the Ahmedabad District Court’s decision.

However, he preferred to withdraw his petition at the time of admission of the case, with the plea that he wanted to take up his contentions before the tribunal.

Interestingly, the proceedings were pending before the tribunal and the interim order by the court had only allowed his petition partly.

The division bench of Justice D.H. Waghela and Justice M.D. Shah dismissed the petition as withdrawn with the observation that frivolous litigations may be spurned.
