New Delhi : The central government Tuesday filed before the Supreme Court a set of documents supporting its plea seeking a stay on the Andhra Pradesh High Court verdict quashing 4.5 percent reservation for minorities in central government educational institutions and jobs within 27 the percent OBC reservation.
Additional Solicitor General Gourab Banerjee made a mentioning to this effect before the apex court vacation bench of Justice K.S. Radhakrishnan and Justice J.S. Khehar.
The documents in support of the central government’s defence of 4.5 percent sub-quota were filed Tuesday in pursuance to the apex court’s direction Monday.
The apex court Monday had asked Attorney General G. Vahanvati to place before it all the documents that the government had relied upon for earmarking 4.5 percent sub-quota for minorities within the overall 27 percent reservation for OBCs.
The nearly 800-page documents filed by the central government include Justice Rajinder Sachar’s committee report on the socio-economic status of Muslims, and extracts from the Ranganath Mishra Commission and Mandal Commission reports. The central government has also filed the 1993 list wherein backward castes among Muslims were identified for reservation under OBC category.
The documents also point to a similar reservation being enjoyed by the backward castes among Muslims in Kerala and Karnataka.
The Andhra Pradesh High Court May 28 had quashed the 4.5 percent sub-quota created last year. The court observed that the issuance of the office memorandum for creating the sub-quota was rooted in religious basis and not any other constitutional consideration.
