Delhi High Court order on Jamiat Ulama-i-Hind dispute

New Delhi: On an appeal filed by Jamiat Ulama-i-Hind (JUH) and its president Maulana Arshad Madani, Delhi High Court on 11th April stopped all parties to the case from interfering in the affairs of JUH.

The court stopped all parties including Maulana Mahmood Madani, JUH general secretary, Maulana Qari Mohammad Usman, deputy director, Darul Uloom Deoband (who was nominated president by the JUH general council called by Mahmood Madani on 5th April) and anyone on their behalf from using JUH minute register, cheques and bank account. The court has asked Maulana Mahmood Madani and Maulana Qari Mohammad Usman to file their response by 8th November.

In the appeal filed by advocate M. Tariq Siddiqui on behalf of JUH and its president Maulana Arshad Madani, the court was also requested to order for returning all records of JUH along with cheque book and account book that was also accepted by the court. In the petition, Maulana Mahmood Madani was addressed as ex-general secretary of JUH.

The dispute began on 6th March when JUH executive committee called by Maulana Mahmood Madani passed a no-confidence motion against JUH president Maulana Arshad Madani and Maulana Qari Mohammad Usman was appointed acting president.
On 5th April Maulana Mahmood Madani called the JUH general council meeting which ratified the 6th March decision of the executive committee. In the meantime, efforts were made from several quarters including Maulana Marghubur Rahman, rector, Darul Uloom Deoband, and some Muslim organizations like Jamaat-e-Islami Hind to resolve the dispute but to no avail. Maulana Arshad Madani described the 6th March decision as unconstitutional, saying the JUH constitution had no provision to bring a no-confidence motion against its president.
