New Delhi : The Delhi High Court Thursday rejected controversial politician Madan Gopal Bhaiyya’s plea to quash attempt-to-murder charges framed against him by a trial court for firing at policemen in the capital eight years ago.
Justice Sanjay Kishan Kaul said: “The trial court has framed charges against him after prima facie finding evidence against him and this court does not find any infirmity in the order passed by the judge.”
Madan Bhaiyya of the Rashtriya Lok Dal, at present out on bail, is a legislator from Kehkra in Uttar Pradesh.
He along with three others has been facing trial for firing at the policemen near Ashoka Hotel in New Delhi, in which gangster Siriya Pehelwan was killed.
Appearing for Madan Bhaiyya, counsel R.N. Mittal argued there was no evidence against his client in the case except that a weapon, a .30 Mauser, was recovered from his car.
Counsel said the case was not made out against his client as the weapon was locked at the time of recovery.
Earlier, the high court twice refused to hear his petition, stating that some of the witnesses have to be examined in the case.
