Bengaluru: Relatives and lawyer were not allowed to visit PDP chairman Abdunnasir Maudany in the hospital in Bengaluru where he is undergoing Ayurveda medical treatment, according to reports.
The Armed Reserve Police, which is in charge of Maudany’s security, reportedly refused to allow his relative Muhammed Rajeeb and consul Adv P Usman to visit Maudany, despite the permission letter of the superintendent of jail. They tried to meet him to discuss court procedures and medical reports. But the police reportedly told them that permission to visit Maudany would be given only on a court order.
Maudany was admitted at the private Ayurveda hospital in Bengaluru for ‘panchkarma’ treatment on June 7, as directed by the Supreme Court.
Preventing from visiting Maudany is a violation of jail rules and court order, Adv P Usman reportedly said. Jail rules allow close relatives and consul to visit the under-trial twice a week. The court also has ordered to allow relatives to visit in jail. Eventhough Maudany is presently in the hospital, he is still an under-trial, and hence the jail rules and court order are applicable in the hospital also, he added.
The special court had postponed the trial in the 2008 Bengaluru serial blasts case, in which Maudany is 31st accused, to July 7. And the bail plea submitted by Maudany in the Supreme Court will be considered on August 3. Adv Usman tried to visit Maudany to discuss these matters as well as knowing details of his medical treatment, which is also essential to be presented in the court. However, he would submit a copy of the court order, permitting relatives and consul to visit Maudany, before the police. He added that if the police did not allow to visit still, he would move to legal procedures.
Maudany was arrested by the Karnataka police from Kerala on August 17, 2010, while he was on his way to surrender in court. He was in police custody for ten days and was then remanded to judicial custody. He has been in the Parappana Agrahara Central Jail ever since and the bail pleas he had submitted were rejected by courts. He submitted a bail plea in the Supreme Court citing his health conditions and innocence. The first bench which considered the plea was divided over its ruling, and so the plea has been transferred to another bench which will consider it on August 3.
