Mumbai: After deferring many a times finally, Special court of Maharashtra Control of Organized Crime Act (MCOCA) here rejected the bail plea of 9 Malegaon 2006 blast accused today in Mumbai.
Talking to Twocircles.net, Adv. Khalid Azmi, the counsel of accused, confirmed it. “Justice Yatin .D.Shinde, rejected the bail plea citing that at this stage of investigation he can’t grant bail to these accused” he said.
The Special MCOCA Judge Yatin D Shinde granted Central Bureau of Investigation(CBI)permission under section 173 (8) of Criminal Procedure Code to reinvestigate the case when CBI moved the application before a MCOCA court on January, 12 after the statement made by Swami Aseemanand under section 164 Criminal Procedure Code before a magistrate in which he confessed that Hindu groups had carried out the Malegaon blast in 2006 that left 37 people dead and over 100 injured.
After this new development in the case, the 9 accused filed bail plea on January, 17, 2011. Since then the special court has been deferring the dats of judgment several times and finally today rejected the plea.
Gulzar Azmi, Secretary, Jamiat Ulema-I-Hind, Maharashtra, who are fighting the case for these accused, said: “We will appeal in the High Court against bail rejection.”
Kul Jamaati Tanzeem of Malegaon, who is working for the accused on Monday decided to start Jail Bharo Tehreek from March, 16, 2011, if the bail is rejected.
