Court halts sealing of illegal buildings in Ahmedabad

Gandhinagar : The Gujarat High Court Monday halted the Ahmedabad Municipal Corporation’s (AMC) drive against unauthorised constructions.

The bench comprising Chief Justice S.J. Mukhopadhaya and Justice J.B. Pardiwala gave respite to illegal building owners on the condition that they would pay penalties and get their unauthorised constructions regularised under a proposed new law.

The bill on the regularisation of illegal buildings was cleared in the state assembly and is now awaiting the governor’s assent.

Earlier, the civic agency started sealing unauthorised buildings and complexes across the city for violating fire and safety norms, parking norms and user zone norms.

A large number of properties on C.G. road of Ahmedabad were sealed by the corporation mainly due to lack of parking facilities there.

The bench clarified that if the shop owners or buildings did not come under the purview of the proposed new law, the civic body would have the liberty to take action against them.

The petition was filed by Shivlal Purohit seeking compliance of court’s earlier directives to the AMC to take action illegal constructions and encroachment.

The matter would be heard July 7.
