Demolition of illegal temple: Shiv Sena MP and others booked for abusing Tehsildar on duty

Aurangabad (Maharashtra): A criminal case has been registered against Shiv Sena MP Chandrakant Khaire for allegedly abusing and obstructing a civic official for demolishing a temple illegally built on government’s land.

Aurangabad west Shiv Sena MLA Sanjay Shirsat and 30 unidentified party activists have also been named in the FIR registered at MIDC Waluj Police Station.

The case is registered under Section 353 (assault or criminal force to deter public servant from doing his duty), 143 (punishment for unlawful assembly), 294 (obscene acts), 114 (abettor present when offence is committed), 504 (intentional insult with intent to provoke breach of the peace) and other relevant sections of IPC.

Following high court orders, District Collector Nidhi Pandey had ordered to raze six religious places in Waluj. Accordingly, Tehsildar Ramesh Munlod had led the drive on Thursday and removed the encroachments and the illegally-built religious places.

Aggrieved with this, Khaire had racked up a controversy after he was caught on camera hurling abuse at Munlod after a demolition drive in an industrial area of Waluj MIDC around 15 kms from the city here. Khaire had called Munlod ‘Aurangzeb ki aulad’ and told him temples cannot be demolished in Hinduraj.
Initially, Munload did not file police case but later on when he received support from many government departments he filed complaint alleging that Khaire and others forcefully stopped their work, when they were removing a Hindu temple portion at Waluj locality and later abused and manhandled him.

Extending strong support to Munload, all revenue employees from the Revenue Gazetted organisation, Tehsildar Organisation, District Revenue employees organisation, Talathi organisation and other related revenue departments had resorted to an agitation and held demonstration in front of District Collector office and Divisional Commissioner office on October 31, protesting against the behaviour of the MP and delay in registering of case against him and others.

In an another development, activist Bhagwanji Raiyani informed Bombay High Court while hearing of a Public Interest Litigation (PIL) filed by the Society for Fast Justice, an NGO, against illegal shrines in the city, that Shiv Sena MP obstructed demolition drive and also abused the demolition squad.

A Bench of justices A S Oka and V L Achliya, which was hearing the matter said,” If what is alleged is correct, there will be very serious impediment to the implementation of the May 5, 2011 government resolution issued in terms of the Supreme Court’s direction to demolish illegal shrines.”

However, state government submitted the draft of a Government Resolution (GR) before the Bombay High Court stating that it will start demolishing all illegal religious shrines that came up after September 2009, within nine months.

Based on a Supreme Court order, a state GR dated May 5, 2011 had prescribed a ‘well-defined’ scheme for appropriate action against unauthorised religious structures.
