Kashmir terror link case: Trial postponed till Aug 18th

Kochi: The primary trial of the Kashmir terror case in which four people from Kerala were killed in an encounter with the Kashmir police in Kupwara, has been postponed to August 18 by the Thalasseri Additional District Sessions Court. Judge K Babu issued the order postponing the trial as the public prosecutor PV Hari asked for more time to study the case.

Adv PC Noushad, lawyer of the accused, informed the court that he would not object to the reading of the chargesheet and beginning of the trial, yet the court decided to go by the prosecution. However, the lawyer submitted bail plea for all the seven accused who were present in the court, accusing the prosecution of delaying the case. The bail plea will be taken into consideration when the case is again taken up on August 18.

Four people from Kerala were reportedly killed and another one injured in encounters with the security forces in Jammu and Kashmir in October 2008. An enquiry into the matter resulted in the registering of a case against 23 people under the Unlawful Activities (Prevention) Act. The 23 people were made accused of several charges ranging from indulging in terrorist activities in the state and recruiting youth for terrorist activities to wage war against the country.

The trial of seven accused was to begin yesterday. All the seven accused – Muhammed Nainar of Kannur (accused no 6), Firose of Ernakulam (accused no 12), Thayyil Shafas (accused no 14), Sabir P Bukhari of Ernakulam (accused no 16), VK Anas (accused no 17), Aanayidukk Shaneej (accused no 18) and Panayappilli Abdul Hameed (accused no 19) – were present in the court.

Police investigation into the alleged conspiracy to recruit youths from Kerala into terrorist organizations found Thadiyantavide Naseer as the mastermind behind this. He is the third accused in the case and has not been arrested yet, as he is absconding. The police also said that the Noorisha Thareeqath based in Hyderabad was used by the accused as a platform for recruitments.

Six accused in the case are now in judicial custody in Bangalore as the Bangalore police had found them guilty in the Bangalore blasts. The Gujarat police also filed a report stating that some of the accused had a role in the Ahmedabad blasts too. Four accused in the case are those reported to be killed in the encounter in Kashmir – Fayas, Fayis, Abdul Raheem and Muhammed Yasin alias Roy Mon Varghese.
