Karachi : A division bench of Sindh High Court (SHC) comprising of Justice Azizullah M.Memon and Justice Arshad Noor Khan on Wednesday issued notices to the respondents including Election Commission of Pakistan and Sardar Mir Ghulam Abid Khan Sundrani while hearing a constitution petition filed by Raja Ghous Bux Bijarani who alleged massive rigging, bogus polling and taking over of polling stations.
The bench while issuing notices to the respondents also ordered that “in case results are not notified such publication (of official gazette notification) would be subject to the decision in the instant petition”.
Earlier, Abrar Hasan counsel for petition relying on different case laws submitted that under High Court is entitled to intervene in such matters where there are glaring examples or if petitioner is rendered remedy less.
There are a number of such examples of bogus voting from at-least 25 polling stations of the constituency where petitioner got no vote despite the fact that he was a ticket holder of PPPP while candidate returned/respondent got thousands of votes.
One of polling station was established in a building used for storing fodder, submitted counsel besides in Kachho ( forest) area and in one case on an Island no habited by one yet thousands of votes were cast in these polling stations, he submitted.
He submitted that although under section 52 of Peoples Representation Act, Elections Tribunals are the only forum which are to be established after a week general elections are held, yet in some cases SHC can intervene.
The bench after hearing the contentions of the counsel for petitioner issued pre-admission notices to respondents for a date to be fixed later. Meanwhile, a number of constitution petitions challenging results of elections were either dismissed as withdrawn, disposed off or dismissed by the bench as four elections tribunals have been established comprising judges of SHC.
