Holding 31-year-old Amarjeet, a labourer, guilty of culpable homicide not amounting to murder, Additional Sessions Judge Sanjeev Kumar sentenced him to 10 years’ jail, saying that he had no premeditated intention to kill his wife.

The court showed some leniency to him in awarding the jail term as he had a three-year-old son to look after, but imposed a fine of Rs.50,000 on him.

The court rejected the man’s plea that he and his wife had quarrelled over the issue of sexual intercourse and she had stabbed herself.

“The convict has stabbed his wife and caused her death, but he has one child to look after. Therefore, in the facts and circumstances of the case, in my view, punishment for 10 years’ rigorous imprisonment would be sufficient to meet the ends of justice,” the court said.

“From the evidence produced, it is not proved that accused has any premeditated intention to cause the death of his wife. It appears that due to sudden quarrel between the accused and the deceased, he became infuriated and in the spur of the moment he stabbed the deceased with a knife which may be lying in the room,” said the order of court.

“Circumstances suggest that he may have had an intention to injure her but he had no intention to kill her, otherwise, he would have given multiple blows, which is not the case,” said the court.

Amarjeet on May 12, 2011, forced his wife Chhoti Devi, sleeping with their son on the roof of their house, to come downstairs. When she came to the ground floor, the couple ended up having a fight, after which Amarjeet stabbed her once and fled from there.
