7/11 Blasts trial: Defense lawyer claims recorded confessional statements of accused were drafted by ATS

Mumbai: What might prove to be one of the strongest argument to corroborate evidences of innocence of 13 accused persons in 7/11 Mumbai local train blasts case, one of the defense lawyers has claimed that all the 7 alleged confessional statements recorded under section 18 of MCOC Act were actually drafted by one of the official of ATS which were later on forwarded to 7 different DCPs who as a formality signed them.

To substantiate the claim defense lawyer pointed out same mistakes from all the 7 recorded confessional statements of accused persons and concluded that all confessional statements were typed by one ATS official and then were forwarded to 7 different DCPs to complete legal procedure.



Jamiat Adv. Abdul Wahhab Khan was presenting his final argument in the case before Special MCOC judge Y D Shinde when he brought to the notice of judge same not ‘similar’ mistakes from 7 alleged confessional statements which were recorded by 7 different DCPs of the city. He argued that even the letters which were written by 7 DCPs in response to letter of investigation officer showing their willingness for recording of accused persons’ confessional statements were in the same format without any difference. He continued his argument and said that it could never be possible for 7 DCPs to make same mistakes while recording confession of accused persons and to keep same format in replying to letter of investigation officer.

He concluded that it was not a mere coincidence but that those confessional statements were written by one ATS person and then forwarded to DCPs for obtaining their signature below it.

To raise more doubts on the truthfulness and correctness of the alleged confessional statements he produced true copy of the information obtained by one of the accused person under RTI Act according to which all the 7 DCPs were deployed for the duty of Prime Ministers security in the city at the very time and date when the alleged confessional statements of 7 accused persons were recorded by those DCPs. He presented an authenticated copy of the information obtained from government office and flattened the prosecution’s claim of accused persons willingly confessing involvement in the serial blasts. The case proceeding was then adjourned till next week.

Adv. Abdul Wahhab Khan and other defense lawyers will continue their final argument before the court on the next hearing date.

7/11 blasts case investigation by ATS was always objected by many Muslim organizations including some human rights observing NGOs in which they arrested and charge sheeted 13 Muslim youths.

The ATS investigation became controversial in September 2008 when Sadiq Israr Shaikh, suspected IM founder was arrested by Mumbai Crime branch and claimed that the serial blasts in Mumbai local trains were actually carried out by IM module. In his allegedly video graphed confessional statement he had narrated how he and his accomplices Atif Amin (who was killed in Batla Hause encounter), Abu Rashid and Riyaz Bhatkal carried out the blasts. ATS theory as mentioned in their charge sheet was in total contrast with what Sadiq had said in his alleged confession.

Depending upon Sadiq’s alleged confession he was made accused in cases blasts in Gujarat , Hyderabad, Delhi, Gorakhpur, US embassy in Kolkata and a case registered in Mumbai of sending of threatening email prior to blasts in Gujarat and Delhi.

Ever since Sadiq Shaikh allegedly confessed Indian Mujahideen’s hand in orchestration of 7/11 blasts the dubious character of Maharashtra ATS was made clear before the public and now ATS is applying every possible strength in convicting arrested and charge sheeted accused persons to prove their investing as right and justified.

The trial is in the last phase where the prosecution has completed his final argument and has urged court to award harsh punishments to accused persons and defense lawyers’ argument is in progress who are trying hard to prove innocence of accused and are producing every minute evidence before court to counter ATS investigation.
