Maudany: a life between cases and law-courts

Be it his first phase as the exciting orator who was political and religious leader, or his new phase of life as the calmed down political leader voicing for justice of the minorities and other backward sections of the society, Abdunnasir Maudany has always created news in Kerala. Now, again he is in news with the latest allegations of his involvement in the 2008 Bengaluru serial blast case. The man who has been in jail for about 10 years in connection with the Coimbatore blasts and was released after the court find him innocent has now been charged with conspiracy in the Bengaluru blast. The Karnataka police is now in Kerala and Maudany could be arrested any time.

When Maudany is on the verge of another jail term only three years after his release from the Coimbatore jail, let us have a look at the life of this man of news. How did the religious preacher and political leader end up as a suspect in blast and terrorism cases?

Abdunnasir Maudany was born as the son of Abdussamad Master in 1965. After formal education, he obtained the Maudany degree from the Ma’dinul Uloom Arabic College in Kollam. He continued his studies in the Jamia Nooriya Arabic College (run by EK Sunni faction) at Pattikkad in Malappuram. After the completion of his studies Maudany began to make religious speeches in different places especially in southern Kerala. He became a popular orator in Kollam and Thiruvananthapuram districts. Maudany also worked with his father at the Anvarssery Orphanage which the latter founded in 1987. In the meantime, he married Soofiya and the couple has got two children – Salahudheen Ayyoubi and Omar Mukhthar.

Maudany came to limelight by his exciting, and often inflammatory, speeches which he made surrounded by his own team of guards to protect him. He was a religious preacher who had his own political views. The speech of this gifted orator attracted huge crowds. May be, this prompted him to the political field. Maudany first formed the Islamic Service Sangh in 1990, as an answer from the Muslim community to the RSS. It was a cadre organisation which gave high importance to martial arts and resistance. The ISS, combined with his speeches, gifted him several enemies and in 1992, Maudany lost his right leg in a bomb attack which was traced back to some RSS activists. It was known to be an attempt on his life. (After release from Coimbatore prison Maudany forgave his attackers.) The ISS was banned in the same year.

Maudany formed the People’s Democratic Party in 1993. The PDP was more like a political party of the minorities and other oppressed sections of the society. But, Maudany’s speeches remained the same. If the earlier speeches had a communal tinge, the new ones had a more political tinge. The PDP helped the Left Democratic Front (LDF) in several elections. Maudany used to make strong and exciting speeches and people flocked to hear him. But the huge crowds did not always turn into votes. Headed by Muslims, the PDP mainly aimed at Muslim votes but the Muslim League had already made up their strong vote-bank which none could break lose, especially in Malappuram district. The PDP had some support in southern Kerala, especially in Kollam district which was Maudany’s home district.

In Coimbatore jail

The Coimbatore serial blasts took place in November 1998. It was said to be an attempt to eliminate the then Home Minister and BJP leader LK Advani. The bomb exploded at an election campaign venue where Advani was to participate. Several people were arrested, mainly those associated with the Tamil group Al Umma. Maudany who already had a bad reputation for his inflammatory speeches was arrested by the Kerala police one night from his home. He was then handed over to the Tamil Nadu police. Maudany was accused to be one of the conspirators of the Coimbatore blast. But there was no evidence or proof other than the confessions of some of the accused. And there began Maudany’s life of nearly 10 years in prison. He was imprisoned in Coimbatore and Salem jails. Being a handicapped with other illnesses like hypertension and diabetes, Maudany requested for medical treatment in jail but was not reportedly provided good treatment. His artificial leg needed proper maintenance which could not be given in jail. He asked for Ayurvedic treatment but the treatment he got was not very helpful. Maudany’s wife and parents used to visit him in the beginning. Then he was in solitary confinement for nearly four years. Nobody could visit him at that time, not even his wife and children. When that phase ended and elections were on cards, political leaders also went to visit him. Though they tried to hide the visits from the media, the news was always leaked out. Letters were passed between Maudany and the leaders. At one time it would be leaders of the LDF and other times it was the United Democratic Front (UDF). Both sought his support during elections and forgot him after that. And thus he languished in the prison for nearly 10 years.

A jailed Maudany was a great comfort to many. The RSS and the Hindutva groups found an end to those inflammatory speeches which excited people against them. The Congress and Muslim League found a relief from the harsh attacks of Maudany, the strong speeches that attracted huge crowds. The LDF counted handing over Maudany to the Tamil Nadu police as one of the advantages of the government. Maudany was always a fundamentalist for the media. All celebrated the new plight of Maudany.

But there was a group of dedicated people including certain human rights activists who believed Maudany was framed in the Coimbatore case. They believed he was trapped in the case as he talked of Muslim-Dalit unity and the political uplift of the backward sections of the society. They knew he was a headache for all political parties and leaders. They provided legal help for Maudany. They collected funds to run the case from the common people in the state.

However, the people of Kerala did not forget the handicapped man languishing in jail for years as an under-trial without even a chargesheet against him. Some of the media brought the plight of Maudany into public attention and gradually, public opinion turned in his favour. The political parties which branded Maudany as communal had to bow down before the strong public demand for ensuring human rights to the Kerala leader suffering in Tamil Nadu jail. The Kerala Assembly passed a unilateral resolution demanding to ensure human rights to Maudany. Political leaders, of both the LDF in whose rule Maudany was arrested and handed over to Tamil Nadu and the UDF whose government stated in court that giving bail to Maudany would create law and order problems in the state, visited Maudany in jail. They approached the Tamil Nadu government with Maudany’s issue. At last, Maudany was released after the court found him innocent of the charges. The court declared him innocent but long ten years of his youthful life was already gone. The 40-year old weighed just around 40 kilograms when he came out of jail in August 2007.

After release

Maudany was given a huge welcome in Thiruvananthapuram where state ministers were present. Leaders representing several organizations were present at the programme. Then there was a list of welcoming programmes in Kozhikode, Ponnani, etc. People again swarmed to hear the fire-brand leader’s exciting speeches. However, the speech was still exciting but the tone and words were different. Maudany was a changed person after the jail term. He publicly apologized for the speeches he had made in the past which hurt the religious feelings of other communities. He promised to be a person of peace and calmness, though not compromising on the policy of Dalit-Muslim-backward classes’ unity through his political party. After some months of medical treatment, he started his political life at the Anvarssery Orphanage which now also serves as the main, though unofficial, centre of the PDP.

The PDP gave support to the LDF in all the 20 constituencies in the 2009 Parliament elections. The party was like an ally of the CPI (M) in its campaigns. CPI (M) state general secretary Pinarayi Vijayan shared stage with Maudany in the election campaign in Ponnani constituency which brought a big hue and cry about the CPI (M) leaving its secular face and supporting communal forces. Interestingly, no such cry was heard when the same CPI (M) sought and received the support and votes of Raman Pilla and Uma Unni, both former fire-brands of the BJP. However, to the bad luck of Maudany and the CPI (M), the LDF could win only four seats in the election. Muslim League’s ET Muhammed Basheer won in a large margin in Ponnani where the CPI (M) had fielded Hussain Randathani (said to be Maudany’s nominee) snatching the seat from its ally CPI. The defeat of the LDF gave a huge boost to those forces which had vehemently opposed the CPI (M) keeping the PDP together.

During the election campaign news arose linking Maudany with terrorism. There was also news that Maudany’s wife Soofiya was associated with some terrorists. Soon, Soofiya was charged in the Kalamassery bus-burning case in which a bus of the Tamil Nadu Corporation was set fire at Kalamassery in Ernakulam. The police suspected it as the revenge of Maudany’s supporters at the continuous denial of bail to him. (But, actually the incident took place at a time when a bail plea of Maudany was being considered in a Tamil Nadu court.) Things got a new light when Thadiyantavide Naseer, suspected to be the commander in chief of the Lashkar e Toiba in South India, was arrested in Bangladesh and handed over to India. Naseer was reportedly involved in the Kalamassery bus-burning incident as well as the Bengaluru blasts along with several other cases in Kerala including the Kashmir terrorism case. Naseer is the prime accused in the Bengaluru blasts. Maudany and Soofiya were accused of having telephone conversations with Naseer. (Soofiya explains that she might have talked to him as many people had phoned her to know about Maudany’s conditions when he was in jail.)

Maudany was named 31st accused in the additional chargesheet filed in the Bengaluru blast case in early June. A Bengaluru court issued a non-bailable arrest warrant against Maudany who then submitted an anticipatory bail plea. The arrest warrant is being extended by the court as the police claim they had not been able to arrest him. The anticipatory bail plea was rejected by a Bengaluru court which prompted Maudany to approach the Karnataka High Court. The HC rejected Maudany’s plea on August 3 and the man had decided to approach the Supreme Court. The arrest warrant has again been extended till August 17. Maudany has now decided not to approach the Supreme Court when the Karnataka police is already in the state to arrest him, with the support and cooperation of the Kerala police. However, Maudany maintains he is innocent of the charges, at the same time promising to abide by the law. He reiterates his faith in Indian judiciary and says that he is ready to abide by the law, whatever be the court’s decision.

Naming Maudany in the chargesheet came nearly five months after Naseer was arrested. The police had reportedly said that evidence against Maudany was got from Naseer, but Naseer later denied it when he was taken out of the NIA court in Kochi. He blurted out to the media that he had not given any testimony against Maudany. The lawyers of Maudany claim that the case is framed up and the chargesheet has many contradictions. One of the witnesses who had lent his house to Maudany has reportedly filed a case against the Karnataka police of forcing him to sign a paper in which something was written in Kannada language which he didn’t know. The paper was reportedly presented by the police as the man’s testimony against Maudany. Another witness is Maudany’s own brother who says he had not been even approached by the Karnataka police. The chargesheet reportedly accuses Maudany of taking part in the terrorism camp organized by Naseer at Kudag in Karnataka. Maudany’s lawyers argue that it could not be possible as Maudany had state protection and was accompanied by police everywhere he went. Also, all travel details of Maudany were available with the state home department.

PDP leaders went on an indefinite fast satyagraha for ensuring justice to Maudany from June 16 to August 10. Certain human rights activists as well as leaders of Dalit and minority organizations also participated in the fast expressing solidarity. PDP activists and other supporters are flocking to Anvarsseri hearing the news of the arrival of the Karnataka police in the state. Even though Maudany has said that he was ready to court arrest, the PDP leaders and members are adamant that they won’t leave their leader to another indefinite jail term. Maudany also has expressed his fear that he might not come out of jail this time, unlike in the Coimbatore case, as the case has been very well planned enough not even to let him get an anticipatory bail.

In the midst of all these controversies, the mainstream media in Kerala is busy portraying Maudany and wife as terrorists. Political parties that used Maudany for electoral gains now wait for ‘the law to take its course’ (as said by Congress and Muslim League leaders). The government is ready to help the Karnataka police to arrest him. The mainstream cultural leaders too are keeping silent about the Maudany hunt. However, there are some human rights activists and other organizations that talk for Maudany – for ensuring justice to the man who has suffered the clutches of delayed justice. They say that whether Maudany has done wrong or not, human rights and justice should be ensured. And the law should take the right course.

can understand the need for such a TESTIMONIAL! But, c'mon, did not Soofia harbour a child at home. She attended school from there. Naseer is just somebody at the end of a telephone line? Was Maudany married to somebody else before Soofia? Were aggrived relatives involved in the dismemberment and so forgiven? Did his inflamatory speech in Ullal cost a deserving Muslim candidate a seat. Did not this evil man's blasphemeous (kul ya ayuhal kafiroon - ring a bell??????????) utterences cause the intial wave that handed over South Canara to the BJP on a platter and then encompass Karanataka? Blasphemy affects everybody period.Did not poonthura Siraj run one of the worst shake-down operations across Kerala with Soofia in tow? It was good business when he was in jail!

He wilfully became LDF's (a party that denies Allah) lap dog, got shooed away after the elections and now they want to wash their hands off the filth and look like heroes at the same time. Will he learn the second time round when LDF again facilitates his return behind bars. Yeah everything is just an RSS plot or concoted by vested interests! Two circles will also need to answer to Allah if it puts out half truths just to play to the gallaries!

Yeah this is the great reformer that sought to destroy his own and then would pick up the rubble and rebuild. to do that you need be a genius or well equiped. This person is neither. A good orator is not necessasarily a good Leader/admistator. Slap stick blasphemy/political satire is good cheap entertainment; but after it wears off, you call always smell the feaces and the bad after-taste. When we fight amongst ourselves; we loose collectively and others stand to gain. Based on this, many a time (2 decades) it has been let bygones be bygones. Madani is a curse to the Kerala Muslims. This is the man who, arrogant of his crowd pulling ability, mindlessly and stupidly disturbed the peaceful communal atmosphere of Kerala for a mosque destroyed in U.P. No doubt there should have been a protest in a democratic manner, but what was the need to challenge and antogonize the Hindus of Kerala, who have absolutely nothing to do with this incident or its perpetrators? Even coming back after 10 years in jail the guy didnt learn a lesson, or simply forgot everything when Pinarayi Vijayan gave him a shake hand and thought that he can thrive by working against Muslim League. Now there will be more scenes with PDP workers defying the attempts to arrest him, and probably taking revenges afterwards, which could further spoil the atmosphere here. My advise is to let the law take the course, for we owe an apology to the Hindus of Kerala.

Hi Shukran, you can talk about RSS and Sanghis until "cows come home". There is no RSS/Sanghi strength in Kerala, they will not even get one assembly vote (as against 20 plus Muslim "sure" seats, mostly Muslim league, but with all the splinter Muslim groups, Muslim league is losing the clout it had once).

So, donot talk about teh MAdni stuff as a RSS initiated stuff..u can get away with that in UP, MP etc, but not Kerala.

Muslims are destroying themselves through people like Madni, and parties like PFI. PFi leaders were involved in the Christian professor hand chopping case, and the revelations of extremist activities will unfortunately put all Muslims under cloud.

As we enter the 9th Ramadan since the war on Islam was declared formally by Ex-President Bush and ex-Prime Minister Blair, and re-iterated by those who came after him : Gordon Brown, Barack Obama, David Cameron, Jose Aznar, Paul Keating, its all to easy to forget that those policymakers and warmongers who have left a catalogue of brothers and sisters behind bars.

We can remember the brothers Khalid Fawwaz and Adel Abdul Bary, arrested on a whim for a baying American public in 1998, with still no charges ever filed in the United Kingdom. This will be their 12th Ramadan this year.

Then those brothers who were rounded up as the British Public demanded that refugees and asylum seekers, especially muslim ones, were welcome no more. The alphabet soup of Detainee Y, X, U, VV, B, G and who knows what other combinations, left to idle their time away in isolation in a special “detainee unit” or else (and perhaps just as cruel) under virtual house arrest with no access to the outside world save for the corner of a housing estate or a small convenience store. For some of these brothers, this will be their 9th Ramadan under these conditions.

We cannot forget as well the brothers serving their sentences and not being allowed to. Subjected to Racist attacks, interference with their correspondence, interference with visits, and a whole host of rules and bureaucracy designed to isolate and stigmatise those Muslims convicted of politically and ideologically motivated offences. Brothers like Eesa Barot, Abdul Aziz Jalil, Junade Feroze, Zia Al Haq, Omar Khyam, Bilal Abdulla, Parvez Khan and countless more. These brothers at the very least have the same rights as any other long-term prisoner, yet because of their religion they are singled out for “special” treatment. Some of these brothers have spent 7 Ramadans in the harshest environments that a british prisoner can experience, though not in any of their letters have they ever shown dissatisfaction with Allahs(swt) decree.

Then there are those in the wrong place at the wrong time, where their alleged offence was hyped and exploited by the press to the extent that a small piece of curiosity has resulted in double digit sentences. Brothers who because of their religion were persecuted by the judge, brothers like Isa Ibrahim, Aabid Khan and more. For a few hours alleged downloading and a few hours alleged reading, these brothers are facing years in prison. For some this will be their 4th Ramadan in prison.

What of those whose biggest fitna is yet to come, those brothers sitting and waiting for the whim of a court decision to be sent to a country without shame, remorse or compassion, that of the United States. Babar Ahmad, Talha Ahsan, and the two brothers mentioned before, Khaled and Adel. These brothers have spent many Ramadans in prison and perhaps many more. May Allah(swt) help them, ameen.

The scholars of the Ummah, locked in the prisons of the tawagheet. Shaikh Abu Hamza al-Masri and Shaikh Abu Qatadah. Both await the qadr of Allah(swt) in different conditions. Shaikh Abu Qatada in the cramped detainee unit of Long Lartin, whilst Shaikh Abu Hamza waits in the HSU of Belmarsh. Those Scholars in other countries, Shaikh Bassim Ayachi or Shaikh Umar Abdur-Rahman. How sad that those who benefited from their knowledge have forgotten how many years these ulema have spent in prison.

Then there are the blatant miscarriages of justice, those who I have never been as convinced of their innocence as I am in their cases, even in the weakest moments where the shaitan whispers. Muhammad Hamid, serving an imprisonment for public protection, when he was the one protecting the public from the hellfire with his dawah and knowledge. This brother alhumduillah he carried the dawah when everyone else was silent. Walking to Marble Arch on the day of the bombings, calling to Allah(swt) and facing abuse but never ceasing his call to non-muslims to embrace Islam. He is now facing his 4th Ramadan in prison. Tarek Mehanna, what more can be said that hasn’t already about this brother. If only muslims knew the debt that us converts owe to such brothers, who call to the truth even though it might harm them.

Then there are those who have already been deported, extradited and outcast to foreign countries in situations where weaker brothers would crumble. Those brothers who find themselves because of political machinations in some of the hardest tests of their Lives. Ali Chehidi, Habib Ignaoua, Mohammed Khemri, all found innocent in Italy of charges, yet still not free, but instead sent to an immigration centre and facing imminent deportation to Tunisia. Farid Hilali, in the foreign country of Spain without income or even an Identity card, forced to depend upon his wife and friends for support and help, shadowed everywhere he goes by foreign intelligence agents, facing deportation to Morocco and yet never convicted nor even charged for the offence he was extradited for.

Rachid Ramda, serving a long sentence and still the fitna is not over, a brother who spent over 10 years in the hardest prison in the UK, and still this was not enough for the French. Evidence that would not hold water in a badly-scripted episode of Miss Marple is instead used to condemn this brother to an extended sentence. This will be his 15th Ramadan in prison.

Reda Dendani, tricked into thinking that the british had an agreement with the Algerians, which they promptly denied. He continues to serve his unjust sentence in an Algerian prison. Mustapha Labsi, a brother who served many years in prison and whose public persona was exploited by different governments, yet the reality is of a brother who loved his wife and child and had them both cruelly taken away from him. He now awaits trial in an Algerian Prison. This will be his 8th Ramadan in prison.

Of course there are those in the prisons of the despots, the torturers, the taghut, and the murtads. Those for whom mental torture is not enough but they must torture the brothers physically and through their families. The Tunisian brother Walid Kammoun, raped and tortured by the Tunisian government, all under the watchful eyes of the Italian government. Mohammed Majid Shakir, held in a concrete coffin in Syria for years by the Italians. Then the Italians themselves, trying to beat brothers into submission, brothers like Rabeh Saeid Osman who was thrashed to within inches of his life. Brothers like Khaled Serai, who was nearly suffocated when the authorities at Macomer cut the air supply of the cell and refused to give him his asthma medication.Brothers like Amine Bouhrama, beaten and beaten again during every prison transfer, left with nothing but a dressing gown after his arrest with all his possessions taken.

Those who harm the families of the believers. Khalil Jarrayas wife, Umm Ibrahmim, kicked out of her house and spat at in the street, her and her four children left homeless by the heartless Italian fascists. A Brothers wife miscarried in the courtroom from hearing of Walid Kammouns torture and rape. The daughter who was kidnapped and sent to a nunnery, or those whose children were taken by Social Sevices.

The brothers in Bosnia, those who sacrified their families and their livliehoods to help the muslims in their hour of need, and look at how that government repays them! Held in a detention centre, no visitors except a few brave sisters, facing deportation to torture in Tunisia or Algeria. Brothers like Ammar Al Hanchi, saved at the last minute from a death in a Tunisian prison, Brothers like Abu Hamze, subhanallah the debt the muslims owe to those brothers and now they languish in a detention centre. Oh Allah(swt) forgive us for our shortcomings.

What of those who serve their sentences in complete isolation, cut off from contact completely under the guise of “good order”. Those brothers in the cruel and unusual punishments of the supermax, brothers like Oussama Kassir, Ramzi Yousef, Richard Reid, Ahmed Abu Ali. Those brothers in the prisons that emulate those dungeons of isolation, brothers in Australia and Canada like Zakariyya Amara, Khaled Cheiko, Abdel Nacir Benbrika and others. That brother who was kept in isolation for 5 ramadans, Mohammed Bouyeri.

Then there are those who are segregated away from the eyes of the world, those brothers in the communication management units, such as Ismail Royer, Rafil Dhafir, Masoud Khan, John Walker Lindh, brothers Subhanallah some of them spending their 9th Ramadan in prison!

What of those whose stories have gaps or are unfinished? Those who suffered at the hands of the oppressors until public opinon made some of their ordeals known? How long have they been detained? Where have they been detained? What unspeakable torture have they suffered? Brothers like Omar Khadr, Khalid Shaikh Muhammad, Hambali, Ahmed Ghafan Ghailani, Majid Khan, and who knows who else. How many ramadans have they experienced? How many have they missed because they were never told? How many were they physically unable to fast because of the oppression they suffered?

The Disappeared. Those whose wherabouts are unknown. Those brothers like Abu Musab Al Suri, his wife left with a young family and not knowing where her husband is and whether he is in a prison cell or a grave. How many ramadans has that brother felt pain and suffered?

Finally, those sisters, sisters like Aafia Siddiqui, persecuted, abused, humiliated, her family distressed all with the complicity and sadism of the United States Government. She faces a long sentence isolated and In the war on Islam instead of the Americans in the dock it is our brave sister. Theres other sisters as well, whose ordeal may not have been as dramatic or as publicised but the pain will still be there, needing healed by sisters willing to give them companionship. Sisters like Yeshmi Girma, Colleen La Rose and others.

Those brothers and sisters mentioned, they are but less than 1% of the total locked up because of their deen and their love for Allah(swt) and His(swt) messenger(saw). Those brothers and sisters who never in one letter doubted Allah(swt) nor His(swt) decree, those brothers and sisters who seek comfort in Allah(swt) and thank Allah(swt) in every letter they send. Brothers and sisters who reveal the personalities behind the headlines, brothers and sisters who could be any one of us.

What I am asking this Ramadan is to offer these brothers and sisters companionship in these testing times. We enjoy the food on our plates, we enjoy our taraweeh, our closeness with families, but we should endeavour to draw closer as well to those captives of the tyrants, to foster the brotherhood that runs through our veins and unites us all on the sunnah and tawheed. Remember the muslim prisoners this Ramadan. You will feel your imaan raise in ways you couldn’t possibly imagine before you wrote, and alhumduillah you will make friends that transcend the traditional boundaries of community and family kinship.

Jazakhallah khair for taking the time to read this. Make this month of mercy, of victory, of repentance, the month of Ramadan, the month we all address our failings towards our muslim brothers and sisters to be the month where we repay the debt that we owe them. Oh Allah(swt) free them from the prisons, reward them for their hardships and bring victory to the ummah, Ameen, Ameen.
