The petition against the government’s move was filed by social activist Rakesh Srivastava and advocate Nityanand Chaubey.

A bench of Justice R.K. Agarwal and Justice R.S.R. Maurya observed: “Today you are releasing them, tomorrow you may give them the Padma Bhushan.” The court also said that whether one was accused or not was a matter to be decided by courts, not politicians.”

Rihai Manch’s president Advocate Mohammad Shoaib and spokesperson of People’s Union for Human Rights (PUHR) Satendra Singh has termed bench’s comment as “unwarranted.” They said this comment is against the prestige of the courts and unsuitable for a court that is set up to protect people’s rights for fair trial.

“UP government’s steps to seek withdrawal of the cases comes under CPC 321 which allows for withdrawal of cases after written permission from the courts, which is what UP government is trying to do,” said Advocate Shoaib.
