Malegaon ’06 blast accused to move court for bail

Mumbai: Smile can soon return to the sad faces of the Malegaon 2006 blast accused languishing in jail for the sins they never committed. Hopeful of their release in the wake of God-send confession of Abhinav Bharat member Swami Aseemanand, the counsel for about a dozen incarcerated Malegaon Muslim youths are moving the court today for
bail.

Advocate Jaleel Ahmed, brother of Abrar Ahmed, police approver in the case who later turned hostile, informed the media near Arthur Road Jail here on Friday that the formalities have been completed and he might move a bail plea on Saturday for all the accused in the Malegaon blast case. Two bail applications will be filed today in special MCOCA court in Mumbai and the rest on Monday.

Adv. Jaleel also informed about the consultations he had with senior lawyers. “We have already sought legal opinion of senior lawyers from Delhi in the case,” he informed.

Replying to a question, Adv. Jaleel Ahmed said first the local Police who handed over the innocents to the ATS are responsible for the plight of the Muslim youths. He said, “Former SP Mr. Rajwardhan, Ramnath Teyagi and Mandeep are the initial perpetrators then Raghuwanshi the former Chief of Anti-Terrorist Squad, Maharashtra is guilty.”

“Terrorism is anti-national and those who support it are equal partners in the crime and they must be prosecuted and punished,” he said.

Adv. Jaleel also demanded that government must compensate these innocent people in proportion to the tortures on them and the sufferings of their family.

Meanwhile, Mr Iqbal, father of another accused Dr. Farog Ahmed Makhdoomi, while speaking to the media in the office of Jamiat Ulama-I-Hind, Mumbai demanded that all the accused must be released on bail at the earliest.

Swami Assemanand, an RSS Prachark, has confessed under section 164 before the magistrate that he and his associates are responsible for many terrorist activities like bomb blasts in Samjhauta Express, Mecca Masjid and both the blasts (2006 and 2008) in Malegaon.

After the confession, Mumbai has witnessed many social and political
activities. Nasim Siddiqui, chairman of Minority Commission, Maharashtra called a press conference and demanded the release of Muslim youths.

A delegation of Kul Jamaat Tanzeem of Malegaon, which was fighting this issue since its inception, visited Mumbai and met RR Patil, Home Minister and Chief Minister Prithvi Raj Chavan and both of them assured that the innocents will be freed.

Since the Malegaon blast 2006 case is with the CBI, Government of Maharashtra has requested CBI to reinvestigate the matter in the light of Aseemanand’s confession for which CBI has got the nod of special court.

A special MCOCA court on Friday granted permission to the CBI to reinvestigate the Malegaon blast case of 2006 in which 37 people were killed and more than 100 injured.

A team of Maharashtra ATS, probing Malegaon blast 2008 has also left to get the certified copy of Aseemanand’s confession.
