Germany-Religi on-Hijab/WRD South German state court rejects lawsuit against hijab ban

Berlin : The highest court in the south German state of Hesse dismissed a lawsuit against the hijab ban for state employees, news reports said Thursday.

The court, based in the city of Wiesbaden, rejected the legal complaint of the Islamic religious community of Berlin, saying the group did not prove their basic rights were violated.

Hesse has barred its state workers in 2004 from wearing the Islamic hijab.

Meanwhile a second lawsuit against the hijab ban has been filed and the high court is to deliberate on the case on August 15.

Several German states have joind Hesse in enacting the hijab ban which many Muslims view as a violation of their constitutional right to exercise religious freedom.

There is no formal hijab ban in Germany, although German federal states are allowed to ban Muslim state employees with headscarves, provided the states have the required legislation on the books to prohibit Muslims from wearing a headscarf at their state jobs, according to a verdict by Germany`s Supreme Court.
