DMK MP C. Kuppusamy had moved the high court in 2002, alleging that former Tamil Nadu chief minister Jayalalitha had given a "false affidavit" for the assembly elections in 2001 when she filed nominations from four constituencies.

Kuppusamy's petition said Jayalalitha had "suppressed the fact" that she had filed nominations from four constituencies. According to Indian election rules, a person is allowed to file nominations only from two constituencies. The AIADMK had won the 2001 elections.

A Division Bench comprising Justice Dharmarao Elipe and Justice S. Palanivelu Wednesday admitted Kuppusamy's petition, five years after it was filed, and directed the Election Commission to take action according to law.

The AIADMK leader is a sitting member of the Tamil Nadu assembly.
