A complaint was filed against Nafisa by one Raj Kumar Pandey for allegedly hurting public sentiments by purchasing a painting of Husain, in which ‘Bharat Mata’ (Mother India) was portrayed in an “obscene manner”.

Nafisa, however, contended that she had not purchased the painting and was only organising its auction for raising money for the victims of earthquake that hit Jammu and Kashmir in 2005.

A lower court in Bhopal had issued notice against Nafisa Ali based on the complaint.

Justice Sanjay Kishan Kaul, in his order, held that “beauty lies in the eye of beholder, so does the obscenity”, and said the painting was just a piece of art in line with country’s ancient culture.

The court gave relief to Nafisa Ali after a recent judgement acquitted Husain, who also faced similar charges.
