The court asked Kidwai to be present before it May 29 and respond to the charges of hate speech in the March 15 political rally.

The Election Commission had asked the returning officer of Chandigarh to register a case against Kidwai following a complaint by the Bharatiya Janata Party (BJP).

Kidwai is alleged to have said if he was a Muslim cleric to issue a fatwa (religious edict) then he would ask all Muslim voters not to vote for political parties other than the Congress.

He allegedly said Muslims were committing biggest sin if they support the BJP.
