The court in Cincinnati, Ohio, rejected his lawyer’s argument that deporting the 89-year-old would be akin to torture due to his fragile health.

The judges also lifted an order made April 14 preventing his extradition.

The State Prosecutor in Munich, Germany, alleges that as a 23-year-old guard in the Sobibor extermination camp, Demjanjuk assisted in the murder of at least 29,000 Jews between March and the end of September 1943.
