Gandhinagar : The Gujarat High Court Friday issued notice to Babu Bajrangi and Jaydeep Patel, two accused in Naroda Gam massacre case of the 2002 communal riots in Ahmedabad, after a special court’s order rejecting access to footage of a sting operation on the duo was challenged by the state government.
“The state government has challenged the order of the special court, trying the Naroda Gam case, rejecting the Special Investigating Team (SIT) plea for access to the CD of a sting operation conducted by a news organisation, to compare the voice of the accused,” said J.M. Panchal, who appears for the state as special prosecutor.
Justice M.D. Shah issued notice to the accused and posted the next hearing for April 19.
The special trial court had rejected the application seeking permission to conduct the voice spectrograph test of Bajrangi and Patel. This order was challenged in the high court, which granted the permission for the test.
However, after the voice samples were collected, the investigating agency sought direction of the trial court trying the Gulberg Society massacre case, to permit the investigating officer to access the CD for the voice comparison. However, the special judge had rejected the plea and the government again approach the high court, challenging the order.
