Swamy to face criminal charges for hate article on Muslims

New Delhi: The Hindutva advocate and Janata Party chief, Subramaniam Swamy might end up being in serious trouble for writing an article which allegedly incited violence and hatred against Muslims. Swamy will have to face several criminal charges initiated by many individual and agencies including the National Commission for Minorities (NCM) which will take multi-pronged action against Swamy.

These troubles will be in addition to the possibility of him getting fired from Harvard Summer School where he is a faculty. Reportedly Nobel laureate Amartya Sen and eminent novelist Amitav Ghosh have appealed to the management of Harvard to fire Swamy. Besides these two intellectual and literary giants, more than 260 Harvardians have run a signature campaign for Swamy’s ouster from the prestigious institution. They will submit their petition in this regard to the Harvard authorities on Monday.

In an article titled “How to Wipe Out Islamic Terror” Swamy had advocated that Muslims should be disenfranchised unless they proudly acknowledged their alleged Hindu ancestry. He also asked the fellow Hindus to declare India a “Hindu Rashtra” and demolish 300 mosques.

A Delhi court on Wednesday sought a report from Delhi police on a lawyer’s plea for lodging a criminal case against Janata Party president Subramanian Swamy for allegedly making anti-Muslim remarks. The court’s direction came following an argument by advocate R K Anand, contending that a prima facie case was made out against Swamy for his “anti-minority” article.

On the other hand, an MP from Wayanad MI Shanavas has filed a petitioned before the National Human Rights Commission seeking its recommendation to the Center to prosecute Swamy.

According to Wajahat Habibullah the NCM Chief, the minority rights watchdog will file an FIR against Swamy for inciting violence (IPC section 158 A-B), malicious insult of religion (IPC section 295-A) and statements constituting public mischief (IPC section 505). Importantly some of the above mentioned sections are non-bailable.

After a complaint by Shehzad Poonawala, a student of law, the NCM has also moved to the Election Commission (EC) requesting it to deregister Janata Party.

“Shri Swamy and the Janata Party do not subscribe nor conform to the principles of secularism and democracy nor does he or his party, of which he is the National President conform to the upholding of the sovereignty, unity and integrity of India as in envisaged under 29(A)5,” says Shehzad in his complaint.

“ The Election Commission of India, which has registered the Janata Party, must take steps to de-register or withdraw the registration of the Janata Party given that an essential condition for registration, stated in the proviso of Section 29(A)7 is not being conformed with,” demands Shehzad.

NCM will also try to get Swamy’s website and other publications blocked.
