Order Wednesday on bail pleas of Kanimozhi, Sharad Kumar

New Delhi: The Delhi High Court is likely to pronounce its verdict Wednesday on the bail pleas of DMK MP Kanimozhi and Kalaignar TV chief Sharad Kumar, named as co-conspirators in the 2G spectrum case.

Justice Ajit Bharihoke May 30 reserved his order on their bail application after the Central Bureau of Investigation (CBI) and the accused’s lawyers concluded their arguments.

The two are lodged in Tihar jail.

Kanimozhi and Sharad Kumar approached the high court May 23, after the trial court May 20 dismissed their application.

“Considering the magnitude of the crime, nature and enormity of the allegation, character of evidence on record and the apprehension that the witnesses may be influenced in case the accused are released on bail, I have no hesitation in holding that both accused have failed to make out prima facie case for bail. Bail applications are without merit and the same are dismissed,” the trial court said.

Kanimozhi and Sharad Kumar’s counsel said the five corporate honchos whose bail pleas were rejected by the court earlier were the main accused in the case.

“As far as my clients are concerned, we are not the allottees of the spectrum,” said their counsel.

The CBI named Kanimozhi and Sharad Kumar as co-conspirators in its April 25 supplementary charge sheet after it traced an illegal money trail of Rs.200 crore in the scam to Kalaignar TV, majority-owned by the family of DMK chief M. Karunanidhi.

Other co-accused in Tihar Jail are former communications minister A. Raja, his aide R.K. Chandolia, former telecom secretary Siddharth Behura, Swan Telecom promoter Shahid Usman Balwa, Swan Telecom director Vinod Goenka, Unitech Wireless’s Sanjay Chandra and three executives of the Anil Dhirubhai Ambani Group – Gautam Doshi, Hari Nair and Surendra Pipara.
