Court dismisses plea of judges seeking reinstatement

Gandhinagar: The Gujarat High Court Tuesday dismissed petitions of four former ad-hoc fast track court (FTC) judges seeking reinstatement in the judicial service on regular basis.

The bench of Chief Justice S.J. Mukhopadhaya and Justice J.B. Pardiwala said that the petitioners – Chetan Harshadrai Shukla, Bharat M. Trivedi, Shabbir Ahmed Abdul Hakim Sheikh and Yoginiben Upadhyay – were appointed as fast track court judges on ad-hoc basis under a central government scheme, which came to an end March 31.

The court said there was no such post under the fast track court scheme and they also could not be absorbed as judicial officers as per the Gujarat judicial service Rules.

Last year, services of 65 such FTC judges, including the four petitioners, were terminated by the state government at the behest of the high court.

They were initially appointed on ad-hoc basis for three years but the authorities kept on extending their term after 2005.
