Complaint filed in UP to lodge criminal case against Facebook

Lucknow: Social activist Dr Nutan Thakur gave a complaint with Inspector, Civil Lines, Meerut for registering a criminal case against social networking site Facebook and several users for creating profiles using
abusve languages against hindu gods and goddesses.

Dr Nutan who is also wife of IPS officer Amitabh Thakur gave application for lodging criminal case under sections153, 153 A(1)(a), 153 A(1)(b), 153 A(1)(c), 153-B, 290, 504, 505 (1), 505 (2),506 IPC and section 66 A Information Technology Act 2000 against Facebook Inc. and others at police station Civil Lines, District- Meerut on Saturday.

She also has highlighted those who are using abusive language on the group. The primary role in this case is that of Baadshah Khan, Meher Jazz, Shekh Aseem, Milesh Shelar, Vijay Chaudhary, Yogi Sewak, Jaheel, Rohit Ramarao patil and others. “There are many others who are using fake names and fake identities to write dirty words on this group site,” she said. At the same time, Facebook Inc, Headquartered at Pao Alto, California, USA has also been made an accused for having provided the requisite platform for dissemination of all these information, particularly when they had been overlooking such information despite repeated requests by many.

In her complain Dr Nutan stated that the Facebook social networking site is seen and shown all across the country through Internet.

“Several groups are formed by users on Facebook and one of them uses abusive language against hindu gods and goddesses. On this site, open abuses and dirty words are used against many revered Hindu Gods and Goddesses and followers of Hindu religion,” she said.

She also informed the police that in response, many people have used equally dirty and hateful words against Islamic teachings and concepts and against followers of Islam. “These dirty words and abuses are of such nature that they violate several sections of the IPC,” she said.

These comments are giving provocation with intent to cause riot when riot is not committed (sec 153 IPC), promoting enmity between different groups on grounds of communities and other grounds etc. and doing acts prejudicial to maintenance of harmony (153A IPC), Imputations, assertions prejudicial to national-integration (sec 153 B IPC), public nuisance (290 IPC), Intentional insult with intent to provoke breach of the peace (sec 504 IPC), criminal intimidation (sec 506 IPC) and using Information Technology for these purposes (sec 66A IT Act).

“Earlier also a similar group “I hate India” was formed on Facebook and I had lodged an FIR with Gomti Nagar police station. Though the Lucknow police has not taken any suitable action in the case so far which has possibly resulted in the accused getting bolstered,” she said.
