New Delhi : The Delhi High Court Wednesday refused to stay the All India Engineering Entrance Examination (AIEEE) results for candidates who appeared for it on two different occasions earlier this month.
A division bench of Chief Justice Dipak Misra and Justice Sanjiv Khanna said: “At this stage we are not inclined to stay the result process.”
The court will further hear the matter on May 20.
Earlier, the same bench rejected a plea for stay of the second phase of the examination, that was re-scheduled for May 11.
Meanwhile, the human resource development ministry and Central Board of Secondary Education (CBSE) filed their replies, which will be considered by the court on next date of hearing.
A group of AIEEE candidates, who had appeared for the exam after a delay of three hours due to a question paper leak on May 1, approached the high court for cancellation of both the examinations (1st and 2nd phase) on the ground that the students were compelled to give the exam under adverse conditions and circumstances, which is violative of fundamental rights.
On May 1, the examination, conducted by CBSE, was delayed by three hours following a paper leak. The exam was scheduled at 9.30 a.m. but was rescheduled for 12 noon on the same day.
The question paper was reportedly being sold in the open market in Lucknow and a man was arrested by Uttar Pradesh Special Task Force.
The organisers had conducted another examination on May 11 only for those aspirants who were not able to appear on the first day and restrained the students who had already appeared for the exam.
