New Delhi : The Delhi High Court Friday allowed the central government’s plea to promote controversial IPS officer Kuldip Sharma, whose annual confidential report (ACR) was allegedly downgraded by Gujarat’s Narendra Modi government, to the rank of director general of police.
A division bench of Justice Badar Durrez Ahmed and Justice Siddharth Mridul while allowing the government to promote the Indian Police Service official, however, said his promotion would be subject to final orders passed in the main writ petition.
“We feel that it would be appropriate to dispose of this application by directing that any order that may be passed with regard to empanelment or promotion would, obviously, have to be in accordance with law and would be subject to final orders that may be passed in this writ petition. With these directions, this application stands dispose of,” the bench said.
The court posted the hearing for Feb 11 next year.
The Gujarat government moved the high court challenging the Delhi Central Administrative Tribunal (CAT) order, which allowed Sharma’s deputation in the central government. Paving the way for his promotion, the CAT raised his grading in the annual confidential report.
The CAT had overruled the Gujarat government’s decision to downgrade Sharma’s ACR from “excellent” to “very good’.
