Hyderabad: Civil Liberties Monitoring Committee (CLMC) has written an open letter to the Chief Justice of India Justice H.L. Dattu urging him to “end the impunity” of the accused and appealed for speedy trial and delivery of justice in the Babri Masjid demolition case.
“Supreme Court of India must give the judgment on Babri Masjid issue and bring the criminals of Babri Masjid demolition under justice to save the secular fabric of India,” CLMC General Secretary Lateef Mohammed Khan wrote, reminding that the Apex Court should understand the concept ‘justice delayed is justice denied, adding that 22 years have already passed.

Sub: – End the impunity on the crime ever happened in human history – Supreme Court of India must give the judgment on Babri Masjid issue and bring the criminals of Babri Masjid demolition under justice to save the secular fabric of India
Civil Liberties Monitoring Committee express its deep concern that even after 22 years of its demolition, Babri Masjid’s criminals are free and Indian judiciary failed to deliver justice. The Allahabad High Court instead of solving the problem has complicated the matter by delivering judgment on the faith of majority community. In the case of Babri Masjid the court has given importance to the hegemony of Hindutva faith and forgotten the constitution of India. With this it can be understood that the country is still a weak secular and democratic state and its judiciary is unable to work independently according to constitution of India. The matter of fact is Indian judiciary utterly failed to handle an unexpected situation in which immediate action is necessary to prevent a bad situation from becoming worse. Even after 22 years, the non construction of Babri Masjid is the proof that the status of Indian secularism and democracy is degrading and it is against the standard of justice.
In fact, now it is a matter of faith of majority vs Indian constitution. Now, it is the time of acid test for Supreme Court of India and the people wait to see whom it gives importance to, Constitution or Faith! The Supreme Court judges should go through the minute details of the case, apply their minds and give the judgment on the basis of rule of law and Indian constitution. If at all Supreme Court, which is the highest and final judicial authority, delivers judgment on the basis of faith, then it will be clear that there would be no future of India.
The Supreme Court should understand the concept ‘justice delayed is justice denied’. Already a lot of time passed away, thousands of people lost their lives, communal hatred reached to its peak level; communal and fascist elements are dividing the people and spreading hatred, and exploiting the situation for their political gains. It has become common during every election that without this issue there is no survival for the political parties, this issue is taken up for vote bank politics and votes and people are polarized. Due to this issue, the real problems of people are neither discussed nor addressed. Actually the real issues are diverted and this issue is raised again and again during every election. The matter of fact is that the Indian politics is roaming around this issue.
Dear Chief Justice of India, in the case of Babri Masjid Supreme Court is not fulfilling its responsibilities as it should have done. The Supreme Court has even failed to protect the structure of Babri Masjid in the year 1992. Just one day sentence was given to Kalyan Singh for his crime, who had assured the Supreme Court that nothing will happen to Babri Masjid but the democratic structure of the country was shaken with false assurance to Supreme Court. This one day sentence of Supreme Court has traumatized the whole civil society. Once again the ball is with the Supreme Court and the whole world is watching whether the supreme court of India is capable to deliver the judgment as per the law of the land and to continue the supremacy of Indian constitution. Therefore, we remind you to “End the impunity on the crime ever happened in human history”.
