Shashi Nandan, the counsel for respondents – Shah and Ali – argued before the HC yesterday and highlighted the two issues – UGC Act and regulations vis-à-vis AMU Act and Statues and how both Shah and Ali come under the category of “Officers of the University”.

Arguing in the case challenging the appointment of both Shah and Ali as vice chancellor and pro-vice chancellor of the AMU respectively, Nandan pointed out that both, being non-teaching in nature, have been duly appointed under the prescribed norms of the University statutes.

The court has fixed December 19 as the next date of hearing in the case, a release from AMU said.

In another matter pertaining to Group Captain Shahrukh Shamshad’s resignation, a divisional bench comprising Chief Justice D Y Chandrachud and Justice PKS Baghel heard the case on issues including the Vice Chancellor’s authority to accept resignation under Section 19(3) of the University Act.

The Court has directed the counsel to submit a personal affidavit by the Vice Chancellor and the Pro-Vice Chancellor on or before January 7, 2015 on issues raised by complainant’s counsel challenging the legality of the meeting of the executive council and also issuance of the office memos.

The case has been listed for final verdict on January 13, 2015, the release added.
