Delhi HC upholds life term for young boy’s sodomy, murder

    New Delhi: Taking a serious view of the sodomy and murder of a two-and-a-half-year-old boy, the Delhi High Court Tuesday upheld the life sentence given to the convict and ordered that the term of sentence will remain “till the rest of his life”.

    A bench of Justice Kailash Gambhir and Justice Sunita Gupta rejected the appeal of Ilyasuddin who moved the high court against the trial court order which sentenced him to life imprisonment along with a condition that he shall not be released before 25 years.

    The high court enhanced Ilyasuddin’s sentence saying the case was an example of “human lust”.

    “It is stated that human lust knows no bounds. If there is any truth in it, the present case is a glaring example of such lust,” the bench said.

    The child not only became a victim of lust of the convict but also lost his precious life, the court said, refusing leniency to Ilyasuddin convicted under sections 377 (sodomy) and 302 (murder) of the Indian Penal Code.

    “The sentence is modified only to the extent that the appellant (Ilyasuddin) will undergo life imprisonment which means till the end of his life,” the order said.

    As per the prosecution, the case relates to March 12, 2008 when the child went missing and was found in a public bathroom in an unconscious state. Ilyasuddin was also lying there unconscious under the influence of liquor.

    The child, having injury marks on his head and body, was taken to a hospital where he was declared dead. The medical report confirmed sodomy.

    The high court refused to interfere with trial court’s order, saying it rightly convicted Ilyasuddin under sodomy and murder charges.
